Kashrus Kurrents, Summer 2022<\/p>\n\n\n\n

Eretz Yisroel is known worldwide for its high-quality produce.\nDuring non-Shemita<\/em> years, a wide selection of  Israeli produce items \u2013 among them: carrots, citrus fruits,\nherbs, peppers, and radishes \u2013 are exported to North American markets. The\ntypical concern is to ensure that\nproper terumos<\/em> and maasros<\/em> are taken. During Shemita<\/em>, terumos\n<\/em>and maasros<\/em> are not typically applicable[1]<\/sup><\/a>,\nbut there is significant concern that the produce may be from Shemita<\/em>.\nIf someone purchased Israeli produce from Shemita <\/em>and paid cash (as\nopposed to by check\nor credit card), returning it to the store may also potentially violate the\nprohibition of doing business with Shemita <\/em>produce. If this happens by mistake, a rav<\/em>\nshould be consulted.[2]<\/sup><\/a>\n<\/p>\n\n\n\n

While it can be assumed that all vegetables<\/em> currently on the\nmarket are from the Shemita <\/em>year,not all Israeli fruits<\/em> yet on the market are from\nthe Shemita <\/em>year. The Halacha is that the Shemita <\/em>status of\nfruits is determined by when they blossomed \u2013 not when they are picked.<\/strong> (Vegetables\nare determined by when they are picked). Therefore, although we are already several\nmonths into Shemita<\/em>,many fruits coming into the market now actually\nblossomed in the sixth year and do not have kedushas shevi\u2019is.<\/em>[3]<\/sup><\/a>Consequently, next year, when Shemita <\/em>is over, <\/em>fruits that\nblossomed during Shemita <\/em>and have kedushas shevi\u2019is <\/em>will remain an\nissue for some time longer.<\/p>\n\n\n\n

Flowers<\/strong> <\/h4>\n\n\n\n

While the majority of the flowers in North America do not come from\nIsrael, some do. The question of whether flowers have kedushas shevi\u2019is <\/em>is\na complex issue. Rav Shlomo Zalman Auerbach zt\u201dl<\/em> ruled that flowers\nharvested primarily for display do not have kedushas shevi\u2019is.<\/em> Since most\nflowers are used primarily for display purposes, they would not be subject to\nthe laws of Shemita. <\/em>This seems to be the accepted minhag <\/em>regarding\nthe status of flower imports from Israel in chutz la\u2019aretz<\/em>.<\/p>\n\n\n\n
