{"id":9509,"date":"2022-07-06T01:45:32","date_gmt":"2022-07-06T01:45:32","guid":{"rendered":"https:\/\/www.star-k.org\/articles\/?p=9509"},"modified":"2022-12-06T01:13:15","modified_gmt":"2022-12-06T01:13:15","slug":"a-consumers-guide-to-sheviis-produce","status":"publish","type":"post","link":"https:\/\/www.star-k.org\/articles\/kashrus-kurrents\/9509\/a-consumers-guide-to-sheviis-produce\/","title":{"rendered":"A Consumer\u2019s Guide to Shevi\u2019is Produce"},"content":{"rendered":"\n<p>Kashrus Kurrents, Summer 2022<\/p>\n\n\n\n<p class=\"has-normal-font-size\">The\nTorah commands us to refrain from working the land of Eretz Yisroel during <em>Shemita<\/em>.\nThe <em>possuk<\/em> states that a person may work the land of Eretz Yisroel for\nsix consecutive years but must allow it to lie fallow during the <em>Shevi\u2019is<\/em>\n(seventh) year.<a href=\"#_edn1\">[1]<\/a>\nThis seventh year is known as <em>Shemita<\/em>.<a href=\"#_edn2\">[2]<\/a> The mitzvah applies to both\nmen and women.<a href=\"#_edn3\">[3]<\/a>\nEven though time-bound positive commandments generally do not apply to women,\nthis mitzvah is an\nexception and is equally incumbent upon them.<a href=\"#_edn4\">[4]<\/a>&nbsp; <\/p>\n\n\n\n<p class=\"has-normal-font-size\">The\nTorah also commands us to sanctify every fiftieth year as <em>Yovel<\/em>.<a href=\"#_edn5\">[5]<\/a> However,\nthe <em>Yovel<\/em> year does not occur nowadays. This is due to the fact that <em>Yovel<\/em>\nis sanctified only when the majority of Jews live in Eretz Yisroel.<a href=\"#_edn6\">[6]<\/a> By\nthe time of the destruction of the first Beis Hamikdash, the majority of Jews\nhad been exiled from Eretz Yisroel and <em>Yovel<\/em> no longer occurred. Although\nJews returned to Eretz Yisroel at the time of Ezra, some <em>shevatim<\/em> chose\nto remain in exile and did not return, which precluded <em>Yovel<\/em> from\nrestarting.<a href=\"#_edn7\">[7]<\/a> &nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-normal-font-size\">Although\nsanctification of the <em>Yovel<\/em> year no longer takes place, the <em>Shemita<\/em>\ncycle continues to occur, and every seventh year is <em>Shemita<\/em>. According\nto the majority of <em>poskim<\/em>, the Torah obligation of <em>Shemita<\/em>\napplies only when <em>Yovel<\/em> applies. As <em>Yovel<\/em> no longer occurs, the\nobligation to keep <em>Shemita<\/em> nowadays is Rabbinic (<em>mi\u2019drabanan<\/em>).<a href=\"#_edn8\">[8]<\/a> There\nis discussion in the <em>poskim<\/em> as to the count of the <em>Shemita<\/em> cycle,\nbut the widely accepted view is that this year, 5782, is <em>Shemita<\/em>.<a href=\"#_edn9\">[9]<\/a>&nbsp; <em>Shemita<\/em> began last Rosh Hashana and\nwill continue until next Rosh Hashana.<a href=\"#_edn10\">[10]<\/a><\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Fruit That Has <em>Kedushas Shevi\u2019is<\/em>: What to Do If You Purchased an Orange?<\/strong> <\/h4>\n\n\n\n<p class=\"has-normal-font-size\">Produce which grows during <em>Shemita<\/em> has <em>kedushas shevi\u2019is<\/em>.&nbsp; This means that (a) the produce does not belong to the owner of the field and is available for others to take; (b) the produce cannot be sold for money;<a href=\"#_edn11\">[11]<\/a> (c) the produce cannot be discarded;<a href=\"#_edn12\">[12]<\/a> and (d) the produce cannot be removed from Eretz Yisroel.<a href=\"#_edn13\">[13]<\/a>&nbsp; If it was wrongfully exported from Eretz Yisroel, it continues to retain <em>kedushas shevi\u2019is.<\/em><a href=\"#_edn14\">[14]<\/a> &nbsp;<\/p>\n\n\n\n<p class=\"has-normal-font-size\">A\nperson may eat a fruit that\nhas <em>kedushas shevi\u2019is<\/em>, but any edible remainder such as the pith, seeds,\nor peel cannot be thrown away. Rather, these should be set aside until they\nstart to rot, after which they may be discarded.<a href=\"#_edn15\">[15]<\/a><\/p>\n\n\n\n<p class=\"has-normal-font-size\">A\nfruit or vegetable may start growing in the sixth year and continue to grow in\nthe seventh year, or start growing in the seventh year and continue to grow in\nthe eighth year. In such cases, it needs to be determined whether or not the\nitem has <em>kedushas shevi\u2019is<\/em>.&nbsp; In\ngeneral, fruit has <em>kedushas shevi\u2019is<\/em> if the budding occurred during <em>Shemita<\/em>,<a href=\"#_edn16\">[16]<\/a>\nwhereas vegetables have <em>kedushas shevi\u2019is <\/em>if they were harvested during <em>Shemita<\/em>.<a href=\"#_edn17\">[17]<\/a><\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Fruit and the Requirement for <em>Biur<\/em>: What to Do If You Purchased Wine?<\/strong> <\/h4>\n\n\n\n<p class=\"has-normal-font-size\">A\nperson may own fruit that\nhas <em>kedushas shevi\u2019is <\/em>and store such fruit for future consumption, provided\nthere is similar fruit still growing in fields in Eretz Yisroel that are\navailable for other people to take.<a href=\"#_edn18\">[18]<\/a>\nHowever, when similar produce ceases to be freely available in the fields, the\nfruit may no longer be stored. At that time, a person who owns and stores fruit\nwith <em>kedushas shevi\u2019is<\/em> should perform <em>biur<\/em> by declaring the fruit\n<em>hefker<\/em> in front of three men. He may then reacquire and continue to\nstore the fruit.<a href=\"#_edn19\">[19]<\/a>\n. The consumer should consult a chart (available online) to ascertain the\nrelevant date for any particular fruit.<a href=\"#_edn20\">[20]<\/a><\/p>\n\n\n\n<p class=\"has-normal-font-size\">If a person intentionally neglects to perform <em style=\"\">biur<\/em><\/a>, the fruit may not be eaten and should be discarded after it has started to rot.<a href=\"#_edn21\">[21]<\/a> The Chazon Ish holds that the fruit is forbidden even if <em>biur<\/em> was not performed because the person forgot or did not know to do so.<a href=\"#_edn22\">[22]<\/a> <\/p>\n\n\n\n<p class=\"has-normal-font-size\">Produce\ngrown during <em>Shemita<\/em> may be distributed through an <em>Otzar Beis Din<\/em>.<a href=\"#_edn23\">[23]<\/a> For\nexample, wine produced from grapes grown during <em>Shemita <\/em>may be sold\ncommercially through\nan <em>Otzar Bais Din.&nbsp; <\/em>The kashrus\nagency certifying the wine will note on the wine label if this is the case, and\nwill also note if <em>biur<\/em> has been performed. Some are of the opinion that\nthis wine no longer retains <em>kedushas shevi\u2019is <\/em>after <em>biur<\/em> is\nperformed, and may be exported from Eretz Yisroel.<a href=\"#_edn24\">[24]<\/a>\nHowever, the prevalent view is that the wine retains <em>kedushas shevi\u2019is,<\/em>\nand the consumer should treat it accordingly.<a href=\"#_edn25\">[25]<\/a><\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Vegetables and the Prohibition of <em>Sefichin<\/em>: What to Do If You Purchased Carrots?<\/strong> <\/h4>\n\n\n\n<p class=\"has-normal-font-size\">During\nthe time of Chazal, there were people who wrongfully planted vegetables during <em>Shemita<\/em>\nand deceitfully claimed that the vegetables grew by themselves. In order to\ndiscourage this, Chazal enacted the prohibition of <em>sefichin<\/em>, which forbids\nthe consumption of vegetables that grew during <em>Shemita<\/em>.<a href=\"#_edn26\">[26]<\/a> There\nare Rishonim who opine that vegetables grown in the sixth year are not included\nin the <em>issur<\/em> of <em>sefichin<\/em> even if they were harvested during <em>Shemita<\/em>,\nand the Chazon Ish accepts this view. These vegetables may be eaten, and would have <em>kedushas\nshevi\u2019is<\/em>.<a href=\"#_edn27\">[27]<\/a>\n<\/p>\n\n\n\n<p class=\"has-normal-font-size\">The prohibition\nagainst the consumption\nof <em>sefichin<\/em> applies only to vegetables and grains but not to fruit, and applies\nonly to produce grown in areas of Eretz Yisrael that were inhabited by Jews at\nthe time of the Second Beis Hamikdash.<a href=\"#_edn28\">[28]<\/a> In\ntheory, vegetables grown in other parts of Eretz Yisroel may be eaten with <em>kedushas\nshevi\u2019is<\/em>. However, due to uncertainty regarding these boundaries, the\nprohibition of <em>sefichin<\/em> applies in all areas of Eretz Yisroel.<a href=\"#_edn29\">[29]<\/a>&nbsp; <\/p>\n\n\n\n<p class=\"has-normal-font-size\">The\nprohibition of <em>sefichin<\/em> does not apply to vegetables grown during <em>Shemita<\/em>\nin the field of a non-Jew.<a href=\"#_edn30\">[30]<\/a> These\nvegetables may be consumed, and the <em>poskim<\/em> debate whether they have <em>kedushas\nshevi\u2019is<\/em>.<a href=\"#_edn31\">[31]<\/a>\nSome <em>rabbonim<\/em> accept the view that this produce does not have <em>kedushas\nshevi\u2019is<\/em>, and advocate that farmers should sell their fields to a non-Jew\nfor the duration of <em>Shemita<\/em>. This suggestion is known as the <em>heter\nmechira<\/em>.<a href=\"#_edn32\">[32]<\/a>\nHowever, the Chazon Ish rejects this position, and <em>paskens<\/em> that such\nproduce would still have <em>kedushas shevi\u2019is<\/em>.<a href=\"#_edn33\">[33]<\/a> Others\n<em>pasken<\/em> that this produce may not be eaten at all, as the laws of <em>shevi\u2019is<\/em>\nwere not followed in these fields.<a href=\"#_edn34\">[34]<\/a><\/p>\n\n\n\n<p class=\"has-normal-font-size\">As\nper these criteria, carrots grown in Eretz Yisroel during the <em>Shemita<\/em>\nyear may be forbidden for consumption due to the prohibition of <em>sefichin<\/em>.\nUnless it can be determined that this is not the case, they should be treated\nas <em>sefichin<\/em> and not be eaten. If they were accidentally used as an\ningredient in cooking, they should be treated as equivalent to a non-kosher\ningredient.<a href=\"#_edn35\">[35]<\/a>\nIf the store from which they were purchased is willing to refund them, Rabbi Moshe Heinemann <em>shlit\u201da<\/em>\n<em>paskens<\/em> that they may be returned.<a href=\"#_edn36\">[36]<\/a> <\/p>\n\n\n\n<p class=\"has-normal-font-size\">Vegetables\nthat grew during <em>Shemita<\/em> remain forbidden even if they are harvested in\nthe subsequent year.
