Does <em>bishul akum<\/em> apply to food cooked in a microwave?<\/span><\/strong><\/p>\n<p><span style=\"font-family: Arial,Helvetica,sans-serif;\"><strong><span style=\"font-size: small;\"><!--more--><\/span><\/strong><\/span><\/p>\n<p><span style=\"font-family: Arial,Helvetica,sans-serif; font-size: small;\"><strong>A:<\/strong>&nbsp; Before answering this question, we must first address whether or not the use of a microwave would be defined by the <em>Torah<\/em> as cooking.&nbsp; <em>Rav<\/em> Moshe Feinstein, zt\u201dl,<a id=\"ftnref1\" title=\"\" href=\"#_ftn1\" name=\"ftnref1\"><sup>1<\/sup><\/a> was asked whether the <em>Torah <\/em>prohibition of cooking on <em>Shabbos<\/em> applies to cooking in a microwave.&nbsp; He answered that, although cooking by the heat of the sun is not considered a violation of the <em>Torah<\/em> prohibition of cooking, this is due to the fact that it is not a standard method of cooking.&nbsp; However, nowadays a microwave is an effective and commonplace way of cooking and, therefore, would be considered a <em>Torah<\/em> violation on <em>Shabbos<\/em>.&nbsp; Based on this, it would seem that using a microwave would also be considered cooking in regards to the prohibition of <em>bishul akum<\/em>.<\/span><\/p>\n<p><span style=\"font-family: Arial,Helvetica,sans-serif; font-size: small;\"> The counterargument is that it is not clear that one should compare the requirements of <em>bishul akum <\/em>to those of cooking on <em>Shabbos<\/em>.&nbsp; <em>Bishul akum<\/em> is a Rabbinic <em>gezeira<\/em>, and the <em>Remah<\/em> tells us that the <em>Rabbonon<\/em> forbade cooking on a flame.<a id=\"ftnref1\" title=\"\" href=\"#_ftn1\" name=\"ftnref1\"><sup>2<\/sup><\/a>&nbsp; It would seem that there is a significant difference between the <em>gezeira<\/em> of <em>bishul akum <\/em>and the prohibition of <em>bishul<\/em> on <em>Shabbos<\/em>. &nbsp;When it comes to <em>Shabbos<\/em>, the <em>Torah<\/em> forbade &#8216;cooking&#8217;.&nbsp; Since using a microwave is considered a normal way of cooking, it is included in the prohibition.&nbsp; However concerning <em>bishul akum<\/em>, the <em>Remah<\/em> tells us that the <em>Rabbonon<\/em> forbade &#8216;a flame&#8217;.&nbsp; Since the <em>Rabbonon<\/em> specified the parameters of their <em>gezeira<\/em>, and using a microwave falls outside those parameters, it would not be included in the prohibition of <em>bishul akum<\/em>. &nbsp;For this reason, the position of the <em>Sefer Chelkas Binyomin<\/em> is that there is no restriction of <em>bishul akum<\/em> with a microwave.<a id=\"ftnref1\" title=\"\" href=\"#_ftn1\" name=\"ftnref1\"><sup>3<\/sup> <\/a><\/span><\/p>\n<p><span style=\"font-family: Arial,Helvetica,sans-serif; font-size: small;\"> However, <em>Rav<\/em> Wosner, <em>shlita<\/em>,<a id=\"ftnref1\" title=\"\" href=\"#_ftn1\" name=\"ftnref1\"><sup>4<\/sup><\/a>feels that it is \u2018obvious\u2019<a id=\"ftnref1\" title=\"\" href=\"#_ftn1\" name=\"ftnref1\"><sup>5<\/sup><\/a> that <em>bishul akum<\/em> applies to cooking with a microwave.&nbsp; He argues that the <em>Rabbonon<\/em> had specific concerns about an <em>akum<\/em> cooking for a <em>Yisroel<\/em>, which led them to institute the <em>gezeira<\/em> of <em>bishul akum<\/em>.&nbsp; These concerns are equally valid whether the cooking is done by fire or by microwave, and the exact mechanics of the cooking process do not impact the <em>gezeira<\/em> of <em>bishul akum<\/em>.<a id=\"ftnref1\" title=\"\" href=\"#_ftn1\" name=\"ftnref1\"><sup>6<\/sup> <\/a><\/span><\/p>\n<p><span style=\"font-family: Arial,Helvetica,sans-serif; font-size: small;\"> Rabbi Heinemann, <em>shlita<\/em>, is of the opinion that the <em>gezeira<\/em> of <em>bishul akum<\/em> applies only to cooking over a flame, and that cooking with a microwave does not fall in this category.&nbsp; He argues that since the <em>Rema <\/em>limits <em>bishul akum <\/em>to cooking on a flame, the \u2018obvious\u2019 conclusion is that the restriction of <em>bishul akum <\/em>does not apply to a microwave.<a id=\"ftnref1\" title=\"\" href=\"#_ftn1\" name=\"ftnref1\"><sup>7<\/sup> <\/a><\/span><\/p>\n<p><strong><span style=\"font-family: Arial,Helvetica,sans-serif; font-size: medium;\">Q:&nbsp; Does a bike shed need a <em>Mezuzah<\/em>?<\/span><\/strong><\/p>\n<p><span style=\"font-size: small;\"><strong><span style=\"font-family: Arial,Helvetica,sans-serif;\">A: <\/span><\/strong><span style=\"font-family: Arial,Helvetica,sans-serif;\">The <em>Torah<\/em> commands a Jew to affix a <em>mezuzah<\/em> to the doorpost of his house,<a id=\"_ftnref1\" title=\"\" href=\"#_ftn1\" name=\"_ftnref1\"><sup>8<\/sup><\/a>&nbsp;as well as the doorposts and doorways within the home,<a id=\"_ftnref2\" title=\"\" href=\"#_ftn2\" name=\"_ftnref2\"><sup>9<\/sup><\/a> with the exception of the bathroom.<a id=\"_ftnref2\" title=\"\" href=\"#_ftn2\" name=\"_ftnref2\"><sup>10<\/sup><\/a>&nbsp; There is a discussion in the <em>Gemora<\/em> and <em>Rishonim<\/em> concerning whether this obligation extends to the doorpost of a barn, chicken coop or grain silo.&nbsp; The <em>Shulchan Aruch<\/em> <em>paskens<\/em> that these locations do, indeed, require a <em>mezuzah.<\/em><a id=\"_ftnref2\" title=\"\" href=\"#_ftn2\" name=\"_ftnref2\"><sup>11<\/sup><\/a> &nbsp;Reb Akiva Eiger understands that one should make a <em>bracha<\/em> when putting up a <em>mezuzah <\/em>at these locations.<a id=\"_ftnref2\" title=\"\" href=\"#_ftn2\" name=\"_ftnref2\"><sup>12<\/sup><\/a>&nbsp; Other <em>Achronim<\/em>, however, feel that because this <em>halacha<\/em> is debated in the <em>Rishonim<\/em> it would be preferable to put up the <em>mezuzah<\/em> without a <em>bracha<\/em>.<a id=\"_ftnref2\" title=\"\" href=\"#_ftn2\" name=\"_ftnref2\"><sup>13<\/sup><\/a>&nbsp; In a case where the grain silo was attached to the house, all agree that the <em>mezuzah<\/em> on the silo door should be put up with a <em>bracha<\/em>.<a id=\"_ftnref2\" title=\"\" href=\"#_ftn2\" name=\"_ftnref2\"><sup>14<\/sup> <\/a> <\/span><\/span><\/p>\n<p><span style=\"font-size: small;\"><span style=\"font-family: Arial,Helvetica,sans-serif;\"> In general, a <em>mezuzah<\/em> is only required for a house in which a person lives.<a id=\"_ftnref2\" title=\"\" href=\"#_ftn2\" name=\"_ftnref2\"><sup>15<\/sup><\/a>&nbsp; Even though no one lives in a barn or grain silo, it still requires a <em>mezuzah<\/em> because the owner uses the room and will enter it whenever the need arises.<a id=\"_ftnref2\" title=\"\" href=\"#_ftn2\" name=\"_ftnref2\"><sup>16<\/sup><\/a>&nbsp; Reb Moshe Feinstein, zt\u201dl, was of the opinion that even an infrequently accessed storage room still requires a <em>mezuzah<\/em>, since the owner will enter at some point to retrieve an item that is stored there.<a id=\"_ftnref2\" title=\"\" href=\"#_ftn2\" name=\"_ftnref2\"><\/a><sup>17<\/sup> &nbsp;However, according to Reb Elyashiv, <em>shlita,<\/em> a storage room requires a <em>mezuzah<\/em> only if it is frequented on a regular basis.<a id=\"_ftnref2\" title=\"\" href=\"#_ftn2\" name=\"_ftnref2\"><sup>18<\/sup><\/a> &nbsp;Rabbi Heinemann feels that a storage room needs a <em>mezuzah<\/em> only if it is accessed at least once every thirty days.<a id=\"_ftnref2\" title=\"\" href=\"#_ftn2\" name=\"_ftnref2\"><sup>19<\/sup><\/a><\/span><\/span><\/p>\n<p><span style=\"font-size: small;\"><span style=\"font-family: Arial,Helvetica,sans-serif;\"> The <em>Shulchan Aruch<\/em> also states that a storefront in a marketplace does not require a <em>mezuzah.<\/em><a id=\"_ftnref3\" title=\"\" href=\"#_ftn3\" name=\"_ftnref3\"><sup>20<\/sup><\/a> &nbsp;The reason for this, as offered by the <em>Taz<\/em>, is because the store owner is not there at night.<a id=\"_ftnref3\" title=\"\" href=\"#_ftn3\" name=\"_ftnref3\"><sup>21<\/sup><\/a> &nbsp;However, this seems difficult to understand.&nbsp; Even though the owner is not there at night, the shop still serves as a storage room for its goods, and a storage room is required to have a <em>mezuzah<\/em>. &nbsp;The <em>Pischei Teshuva<\/em> explains that the store is not required to have a <em>mezuzah<\/em> because it is only used for a few days each year, at the time of the market, and is considered a temporary dwelling.<a id=\"_ftnref3\" title=\"\" href=\"#_ftn3\" name=\"_ftnref3\"><sup>22<\/sup><\/a> &nbsp;Thus, according to the <em>Pischei Teshuva<\/em>, a shop that is used year-round would require a <em>mezuzah<\/em> because it serves as a storage room, even though the items that are stored are not used by the owner but are sold to the public.&nbsp; This conclusion is accepted by the <em>Kitzur Shulchan Aruch<\/em><a id=\"_ftnref3\" title=\"\" href=\"#_ftn3\" name=\"_ftnref3\"><sup>23<\/sup><\/a> and by <em>Rav<\/em> Chaim Kanievsky, <em>shlita<\/em>.<a id=\"_ftnref3\" title=\"\" href=\"#_ftn3\" name=\"_ftnref3\"><sup>24<\/sup><\/a><\/span><\/span><\/p>\n<p><span style=\"font-size: small;\"><span style=\"font-family: Arial,Helvetica,sans-serif;\"> The <em>Ben Ish Chai<\/em><a id=\"_ftnref3\" title=\"\" href=\"#_ftn3\" name=\"_ftnref3\"><sup>25<\/sup><\/a> also suggests this interpretation of the <em>Shulchan Aruch<\/em>.&nbsp; However, he offers an alternative approach, as well.&nbsp; He suggests that a storage room requires a <em>mezuzah<\/em> only when the items within it will be used in the owner\u2019s house.&nbsp; Since the storage room is used for the needs of the house, it is considered an adjunct to the house and, therefore, it is required to retain a <em>mezuzah<\/em>. &nbsp;However, the shop in the marketplace is used only to store items for sale and, therefore, is not required to have a <em>mezuzah<\/em>.<\/span><\/span><\/p>\n<p><span style=\"font-size: small;\"><span style=\"font-family: Arial,Helvetica,sans-serif;\"> The <em>Debretziner Rov<\/em><a id=\"_ftnref3\" title=\"\" href=\"#_ftn3\" name=\"_ftnref3\"><sup>26<\/sup><\/a> also suggests this explanation, thereby addressing the question as to whether a garage requires a <em>mezuzah.<\/em> &nbsp;He argues that since a car is never brought into the house, the garage where the car is stored does not become an adjunct to the house; consequently, the garage does not need a <em>mezuzah<\/em>.&nbsp; <\/span><\/span><\/p>\n<p><span style=\"font-size: small;\"><span style=\"font-family: Arial,Helvetica,sans-serif;\"> However, it would seem that according to the <em>Pischei Teshuva<\/em>, a garage would require a <em>mezuzah<\/em>. &nbsp;As previously noted, the <em>Pischei Teshuva<\/em> argues that a temporary store is exempt from a <em>mezuzah<\/em>.&nbsp; However, a year-round shop would require a <em>mezuzah<\/em>, even though the items that are stored there will not be brought into the owner\u2019s house. &nbsp;So too, even though a person does not bring his car into his house, the garage in which the car is stored would require a <em>mezuzah<\/em>.&nbsp; Furthermore, just as the shop requires a <em>mezuzah<\/em> even though it is not attached to the house, so too would a garage require a <em>mezuzah<\/em> even if it was not attached to the house.<a id=\"_ftnref3\" title=\"\" href=\"#_ftn3\" name=\"_ftnref3\"><sup>27<\/sup> <\/a><br>\nThe <em>Minchas Yitzchok<\/em><a id=\"_ftnref3\" title=\"\" href=\"#_ftn3\" name=\"_ftnref3\"><sup>28<\/sup><\/a> and the <em>Az Nidberu<\/em><a id=\"_ftnref3\" title=\"\" href=\"#_ftn3\" name=\"_ftnref3\"><sup>29<\/sup><\/a> are of the opinion that a garage needs a <em>mezuzah,<\/em> and <em>Rav<\/em> Moshe Feinstein has also been quoted as having <em>paskened<\/em> this way.<a id=\"_ftnref3\" title=\"\" href=\"#_ftn3\" name=\"_ftnref3\"><sup>30<\/sup><\/a>&nbsp; Rabbi Heinemann believes that a garage that is attached to the house, and serves as an entranceway to the house, needs a <em>mezuzah<\/em>.<a id=\"_ftnref3\" title=\"\" href=\"#_ftn3\" name=\"_ftnref3\"><sup>31<\/sup><\/a>&nbsp; However, he agrees with the viewpoint that a storage room is required to display a <em>mezuzah<\/em> only if it is used to store objects that are brought into the house.&nbsp; Therefore, according to Rabbi Heinemann, a bike shed does not require a mezuzah if it is not attached to the house and does not store objects that are used in the house.<a id=\"_ftnref3\" title=\"\" href=\"#_ftn3\" name=\"_ftnref3\"><sup>32<\/sup><\/a><\/span><\/span><\/p>\n<div>\n<div id=\"ftn1\">\n<p dir=\"rtl\"><span style=\"font-family: Miriam; font-size: small;\"><a id=\"_ftn1\" title=\"\" href=\"#_ftnref1\" name=\"_ftn1\"><\/a> 1.\u05e9\u05d5&#8221;\u05ea \u05d0\u05d2\u05e8\u05d5\u05ea \u05de\u05e9\u05d4 \u05d0\u05d5&#8221;\u05d7 \u05d7&#8221;\u05d2 \u05e1\u05d9&#8217; \u05e0\u05d1<\/span><\/p>\n<p dir=\"rtl\"><span style=\"font-family: Miriam; font-size: small;\"> 2.\u05d1\u05e8\u05de&#8221;\u05d0 \u05d9\u05d5&#8221;\u05d3 \u05e1\u05d9&#8217; \u05e7\u05d9\u05d2 \u05e1\u05e2\u05d9 \u05d9\u05d2 \u05db\u05ea\u05d1 &#8220;\u05d3\u05dc\u05d0 \u05d0\u05e1\u05e8\u05d5 \u05d0\u05dc\u05d0 \u05d1\u05d9\u05e9\u05d5\u05dc \u05e9\u05dc \u05d0\u05e9&#8221;&nbsp;<\/span><\/p>\n<p dir=\"rtl\"><span style=\"font-family: Miriam;
