{"id":626,"date":"2013-08-15T20:19:57","date_gmt":"2013-08-15T20:19:57","guid":{"rendered":"https:\/\/www.star-k.org\/articles\/?p=626"},"modified":"2016-05-09T15:48:00","modified_gmt":"2016-05-09T15:48:00","slug":"drinking-responsibly-ii","status":"publish","type":"post","link":"https:\/\/www.star-k.org\/articles\/kashrus-kurrents\/626\/drinking-responsibly-ii\/","title":{"rendered":"Drinking Responsibly II"},"content":{"rendered":"<p><em>Published Fall 2010<\/em><\/p>\n<p>There has probably never been more oversight in the food manufacturing arena than in the areas of consumer awareness, consumer protection and consumer advocacy.\u00a0 Most notably, this has been evident in nutritional labeling, HAACP, ISO, QAI Organic, allergen disclaimers, and salmonella recalls \u2013 the list goes on and on.<!--more--><\/p>\n<p>Kosher food certification has become increasingly popular, serving as another set of \u2018eyes\u2019 to ensure quality assurance for both manufacturers and consumers.\u00a0 Kosher certification has also entered arenas that in decades past have been closed to consumers as a whole, and <em>kashrus<\/em> in particular \u2013 that of the liquor industry.\u00a0 A few decades ago, firsthand knowledge of a company\u2019s proprietary manufacturing secrets was unprecedented.\u00a0 Today, however, with all that has been made available along the information highway, all that was sacred is now available for the liquor enthusiast\u2019s taking.<\/p>\n<p>Coupled with the fact that kosher certification has become an attractive means to capture market share, the industry is booming.\u00a0 Twenty years ago, it was impossible to find a kosher certified product except for <em>heimishe mashke<\/em>.\u00a0 Now, first class scotch companies boast that they are kosher certified \u2013 absolutely amazing!<\/p>\n<p>Kosher food certification has also grown with the times.\u00a0 Certification agencies have become more sophisticated, and the responsibility to the <em>klal<\/em> is a front burner priority.\u00a0 This kosher quality assurance has its pitfalls, but one could say that we are a kosher consumer protection agency, as illustrated by the following true scenario.<\/p>\n<p>A very large company that owned multiple distilleries, distributorships and other holdings approached a very reputable and responsible <em>kashrus<\/em> agency for certification.\u00a0 The kosher certification agency correctly and responsibly questioned whether \u00a0there was Jewish ownership in the corporation. \u00a0To their surprise, they found out that the corporation was a family owned business, and that the sole owners were Jewish and non-observant.\u00a0 This can be a fatal flaw and major disaster in the liquor business, due to the fact that a Jew cannot possess <em>chometz<\/em> during <em>Pesach<\/em>. \u00a0Optimally, a Jewish homeowner must rid himself of all <em>chometz<\/em> in his possession.\u00a0 In the event that the Jew\u2019s inventory is so great that it is impossible to do so, the <em>Rabbonim<\/em> instituted a legal method of discarding the excess <em>chometz<\/em>.\u00a0 The <em>chometz<\/em> may be sold to an <em>aino Yehudi,<\/em> who takes full possession of the <em>chometz<\/em> during <em>Pesach<\/em> with the hope that after <em>Pesach<\/em>, the <em>chometz<\/em> will then be repurchased from the <em>aino Yehudi<\/em>.\u00a0 In the event that the <em>chometz<\/em> is not sold, and the Jew does violate the <em>halachos<\/em> of owning <em>chometz<\/em> during <em>Pesach<\/em>, the <em>Rabbonim<\/em> placed a penalty on that <em>chometz<\/em>.\u00a0 They forbade one to eat or derive any enjoyment or benefit from the \u2018tainted\u2019 <em>chometz<\/em>.<\/p>\n<p>The <em>halacha<\/em> refers to <em>chometz<\/em> that has violated the <em>Pesach<\/em> mandate\u00a0 <em>chometz sheavar alov haPesach,<\/em> <em>chometz<\/em> that has \u2018passed over\u2019 Passover.\u00a0 Failure to sell one\u2019s <em>chometz<\/em> can be a nightmare if one owns a large inventory of <em>chometz<\/em>.\u00a0 The nightmare is compounded when liquor is stored in warehouses, where inventory has been aged in casks for many years. \u00a0It can take many Passovers before the whisky sees the light of day.\u00a0 During that period, the distillery owners have violated multiple prohibitions of <em>chometz sheavar alav haPesach<\/em>, thereby rendering the entire inventory unusable. \u00a0This <em>halachic<\/em> bombshell was discovered with potential far reaching ramifications.<\/p>\n<p>This issue has been thoroughly and accurately researched.\u00a0 Once all the facts were gathered, the issue was presented to the <em>Poskim<\/em> of the major <em>kashrus<\/em> organizations, which comprise AKO\u2019s (the Association of <em>Kashrus<\/em> Organizations) executive committee. The issue was carefully presented and the various <em>tzdadei kula<\/em>, lenient options, were carefully scrutinized.\u00a0 The consensus of the <em>Poskim<\/em> was that one is forbidden to use the unsold <em>chometz<\/em> due to the severity of the violation of <em>chometz sheavar alov haPesach<\/em>, except in cases of extreme financial loss where a <em>rav<\/em> or <em>posek<\/em> should be consulted.\u00a0 Ignorance of the law is no excuse.<\/p>\n<p>Regardless of one\u2019s view on the subject, this was an outstanding example of <em>daas Torah<\/em> in action and <em>kashrus<\/em> organizations working for the betterment of the <em>klal<\/em>.\u00a0 Our job as a <em>kashrus<\/em> certification agency is to try to bring the widest array of kosher products to the kosher consumer.\u00a0 At the same time, it is also our primary responsibility to certify quality kosher products and protect the kosher consumer from any <em>kashrus<\/em>
