You have a live-in maid. The trouble is, you\u2019re very uncertain as to what you can ask her to do and what is and isn\u2019t <span style=\"text-decoration: underline;\">halachically<\/span> permissible. Can she be asked to run the dishwasher, wash the floor or take out the garbage?<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>Scenario #2:<\/strong><\/span> It\u2019s the afternoon of the second day of <span style=\"text-decoration: underline;\">Pesach<\/span>; your house is a hurricane &#8211; dishes are piled up to the ceiling, stains are all over the tablecloths, the floors are sticky and you need some serious help. You have your weekly cleaning lady coming in. The trouble is, you\u2019re very uncertain as to what you can ask her to do and what is and isn\u2019t <span style=\"text-decoration: underline;\">halachically<\/span> permissible. Can she be asked to run the dishwasher, wash the floor or take out the garbage?<\/p>\n<p><strong>Are these two scenarios equal?<\/strong><br \/>\nLet us start at the source. The <em>Shulchan Aruch<\/em> tells us that instructing an <em>Aino Yehudi<\/em> to perform a <em>melachah<\/em> \u2013 an activity which a Jew may not carry out on <em>Shabbos<\/em> or <em>Yom Tov<\/em> \u2013 is forbidden.<a href=\"#1\"><sup>1<\/sup><\/a> This rabbinic prohibition (known as \u05dd\u201d\u05d5\u05db\u05e2\u05dc \u05d4\u05e8\u05d9\u05de\u05d0) was instituted for two reasons:<\/p>\n<ol>\n<li>\u05e9\u05dc\u05d9\u05d7\u05d5\u05ea &#8211; Agency: Generally, an <em>Aino Yehudi<\/em> is not <em>halachically<\/em> considered an agent of a Jew. However, with respect to \u05d0\u05de\u05d9\u05e8\u05d4 \u05dc\u05e2\u05db\u05d5&#8221;\u05dd \u2013 acting on behalf of a Jew \u2013 <em>Chazal<\/em> were stringent and considered an <em>Aino Yehudi<\/em> to be an agent of a Jew.<a href=\"#2\"><sup>2<\/sup><\/a>\u00a0<em>Halachically<\/em>, an act carried out through an agent is equal to an act performed by the principal. Even if the <em>Aino Yehudi<\/em> was asked on a weekday to perform a <em>melachah<\/em> on <em>Shabbos<\/em>, it would be prohibited as he is acting as the Jew\u2019s agent.<a href=\"#3\"><sup>3<\/sup><\/a><\/li>\n<li>\u05d5\u05d3\u05d1\u05e8 \u05d3\u05d1\u05e8 \u2013 One\u2019s manner of speech on <em>Shabbos<\/em> cannot be the same as during the week.<a href=\"#4\"><sup>4<\/sup><\/a> Therefore, on <em>Shabbos<\/em> it is forbidden to tell an <em>Aino Yehudi<\/em> to perform a <em>melachah<\/em>, even if the instructions were to be carried out by the <em>Aino Yehudi<\/em> on a weekday.<a href=\"#5\"><sup>5<\/sup><\/a><\/li>\n<\/ol>\n<p>Regarding the prohibition of \u05d0\u05de\u05d9\u05e8\u05d4 \u05dc\u05e2\u05db\u05d5&#8221;\u05dd, <em>halacha<\/em> differentiates between whether the <em>Aino Yehudi<\/em> is contracted to do a job or a project for a fixed charge (known as a \u05e7\u05d1\u05dc\u05df) or is paid by the hour or by the day for his work (known as a \u05e9\u05db\u05d9\u05e8 \u05d9\u05d5\u05dd).<\/p>\n<p>A \u05e7\u05d1\u05dc\u05df is one who is hired to provide a service or a finished product (e.g., cleaning a suit, fixing a car, sewing a dress, etc.) for a fixed price, irrespective of whether he works on <em>Shabbos<\/em>.<a href=\"#6\"><sup>6<\/sup><\/a> Once the \u05e7\u05d1\u05dc\u05df has accepted the project upon himself, he is <em>halachically<\/em> considered to be acting in his own self-interest to finish the task to which he committed himself.<a href=\"#7\"><sup>7<\/sup><\/a> Although the \u05e7\u05d1\u05dc\u05df is working on <em>Shabbos<\/em>, he is working of his own volition to finish the job. A day laborer, \u05e9\u05db\u05d9\u05e8 \u05d9\u05d5\u05dd, who will be paid specifically for his work on <em>Shabbos<\/em> is <em>halachically<\/em> considered to be acting on behalf of the Jew and is, therefore, forbidden to work on behalf of a Jew on <em>Shabbos<\/em>.<a href=\"#8\"><sup>8<\/sup><\/a><\/p>\n<p>A live-in domestic is generally considered a \u05e7\u05d1\u05dc\u05df, since she has accepted the position of housekeeper for a specified period of time \u2013 a year, month or week \u2013 and is paid a set wage instead of an hourly rate.<a href=\"#9\"><sup>9<\/sup><\/a> Therefore, it is not considered \u05d0\u05de\u05d9\u05e8\u05d4 \u05dc\u05e2\u05db\u05d5&#8221;\u05dd if the <em>Aino Yehudi<\/em> decides of her own volition to finish a job of <em>Shabbos<\/em>.<\/p>\n<p>It is generally forbidden to have <em>melachah<\/em> performed by an <em>Aino Yehudi<\/em> on the property of a Jew.<a href=\"#10\"><sup>10<\/sup><\/a> This is due to the concern of \u05de\u05e8\u05d0\u05ea \u05e2\u05d9\u05df; it looks as though the Jew told the <em>Aino Yehudi<\/em>to work for him. Even though instructing a live-in maid is not \u05d0\u05de\u05d9\u05e8\u05d4 \u05dc\u05e2\u05db\u05d5&#8221;\u05dd because she is considered a \u05e7\u05d1\u05dc\u05df, nevertheless it should be forbidden to have her perform <em>melachah<\/em>on the property of a Jew due to the concern of \u05de\u05e8\u05d0\u05ea \u05e2\u05d9\u05df. Therefore, many contemporary <em>Poskim<\/em> feel that a live-in maid may not do any <em>melachah<\/em> on<em>Shabbos<\/em>for a Jew. However, <em>Reb<\/em>Moshe Feinstein, <em>zt\u201dl<\/em>,<em>paskened<\/em>that a live-in maid may perform <em>melachah<\/em>in a Jew\u2019s house if the following conditions are met:<a href=\"#11\"><sup>11<\/sup><\/a><\/p>\n<ol>\n<li>She is instructed from the beginning that she is not required to do these chores on <em>Shabbos<\/em>.<br \/>\nEven a \u05e7\u05d1\u05dc\u05df cannot be instructed by a Jew to specifically perform <em>melachah<\/em> on <em>Shabbos<\/em>. This is known as \u05e7\u05d5\u05d1\u05e2 \u05de\u05dc\u05d0\u05db\u05ea\u05d5 \u05d1\u05e9\u05d1\u05ea.<\/li>\n<li>There is no \u05de\u05e8\u05d0\u05ea \u05e2\u05d9\u05df, appearance of wrongdoing.<br \/>\nAny type of <em>melachah<\/em> which is not part of the cleaning lady\u2019s daily routine would be forbidden for her to perform on <em>Shabbos<\/em>. This is due to the appearance of wrongdoing, as it would appear as if she was instructed to perform the <em>melachah<\/em> specifically on <em>Shabbos<\/em>. Even though the \u05e7\u05d1\u05dc\u05df was not actually instructed to perform the <em>melachah<\/em>, the concern of \u05de\u05e8\u05d0\u05ea \u05e2\u05d9\u05df would apply.<a href=\"#12\"><sup>12<\/sup><\/a><\/li>\n<li>There is no \u05d6\u05dc\u05d6\u05d5\u05dc \u05e9\u05d1\u05ea, cheapening of the sanctity of <em>Shabbos<\/em>.<br \/>\nAny <em>melachah<\/em> that is degrading when done on <em>Shabbos<\/em> is forbidden (e.g., garden work, washing windows, etc.). Furthermore, <em>melachos<\/em> which attract attention because they are noisy (e.g., vacuuming, running a dishwasher or dryer, etc.) are also included in this exception and may not be performed on <em>Shabbos<\/em>.<a href=\"#13\"><sup>13<\/sup><\/a><\/li>\n<li>There is no prohibited benefit.<br \/>\n<em>Chazal<\/em> forbade deriving benefit from any <em>melachah<\/em> which is performed by an <em>Aino Yehudi<\/em> for a Jew on Shabbos, even if he did it of his own accord without any request from the Jew.<a href=\"#14\"><sup>14<\/sup><\/a> For example, a Jew should not derive benefit if a cleaning lady turned on the lights in a dark basement. <em>Chazal<\/em> were concerned that if a benefit was permitted, one may come to request this type of activity from an <em>Aino Yehudi<\/em> outright in the future.<a href=\"#15\"><sup>15<\/sup><\/a> However, if an <em>Aino Yehudi<\/em> turned off a light on <em>Shabbos<\/em>, a Jew may go to sleep in that room even though he is deriving benefit from the lack of light (because a lack of light is not a direct benefit). Additionally, when there already exists enough light in the room to perform activities (e.g., eat, read, etc.), and an <em>Aino Yehudi<\/em> lit additional light, a Jew may derive benefit from that light. This is because making it a little easier to see is not considered a substantial benefit; only significant \u05d4\u05d0\u05e0\u05d4 was forbidden by <em>Chazal<\/em>.<a href=\"#16\"><sup>16<\/sup><\/a><\/li>\n<\/ol>\n<p>Based upon what we have explained, a live-in maid would be permitted to: 1) wash dishes, even if it is being done for after <em>Shabbos<\/em> or <em>Yom Tov<\/em>; 2) wash floors; 3) fold laundry; 4) take out the garbage; 5) clean the house, even if it is being done for after <em>Shabbos<\/em> or <em>Yom Tov<\/em>; 6) extinguish lights or candles.<a href=\"#17\"><sup>17<\/sup><\/a><\/p>\n<p>The <em>halacha<\/em> would not be the same for a part-time cleaning lady. This is because she is being paid by the hour and is <em>halachically<\/em> considered to be acting on behalf of her employer. Generally speaking, one cannot allow a part-time cleaning lady to do anything that one is not permitted to do himself.<a href=\"#18\"><sup>18<\/sup><\/a> However, there are a number of things one can ask the cleaning lady to do:<\/p>\n<ol>\n<li>One may tell the cleaning lady to do something if it could be done in a permissible way. There is no need to intervene if she chooses to do it in a way which is forbidden, as long as there is no <em>zilzul Shabbos<\/em>.<a href=\"#19\"><sup>19<\/sup><\/a><br \/>\nOne may, therefore, ask a cleaning lady to wash the dishes as long as he says, \u201cI don\u2019t mind if you use cold water.\u201d It would not be necessary to stop her if she chooses to use hot water with a sponge. Similarly, one may request that she wash the floor if he says, \u201cI don\u2019t mind if you just pour water and then dry it\u201d, even though she will probably use a mop.<a href=\"#20\"><sup>20<\/sup><\/a><\/li>\n<li>\u05e9\u05d1\u05d5\u05ea \u05d3\u05e9\u05d1\u05d5\u05ea \u2013 Asking an <em>Aino Yehudi<\/em> to perform an activity which is prohibited by rabbinic ordinance is permitted in the following circumstances: a) <em>Mitzvah<\/em> \u2013 For the purpose of a <em>mitzvah<\/em>. For example, one may ask a cleaning lady to carry a <em>sefer<\/em> or <em>talis<\/em> across the street to someone in another house, even if there is no <em>eruv<\/em> in place. b) Great necessity &#8211; For example, if someone is locked out of his house, he may ask an <em>Aino Yehudi<\/em> to break the lock in order to regain entry.<a href=\"#21\"><sup>21<\/sup><\/a> c) \u05d4\u05e4\u05e1\u05d3 \u05de\u05e8\u05d5\u05d1\u05d4 &#8211; A large loss is expected. For instance, if someone is worried that something expensive may be stolen, he may ask an <em>Aino Yehudi<\/em> to move it to a safe place<a href=\"#22\"><sup>22<\/sup><\/a> (provided he doesn\u2019t need to transport the item through a \u05e8\u05e9\u05d5\u05ea \u05d4\u05e8\u05d1\u05d9\u05dd). d) Slight illness \u2013 One may ask an <em>Aino Yehudi<\/em> to apply liquid medication to a gauze pad and place it on a wound.<a href=\"#23\"><sup>23<\/sup><\/a> (In the case of total body illness, \u05d7\u05d5\u05dc\u05d4 \u05db\u05dc \u05d2\u05d5\u05e4\u05d5, one may ask an <em>Aino Yehudi<\/em> to perform even a \u05de\u05dc\u05d0\u05db\u05d4 \u05d3\u05d0\u05d5\u05e8\u05d9\u05d9\u05ea\u05d0).<a href=\"#24\"><sup>24<\/sup><\/a><\/li>\n<li>\u05e4\u05e1\u05d9\u05e7 \u05e8\u05d9\u05e9\u05d0 &#8211; One may ask an <em>Aino Yehudi<\/em> to perform a permitted activity, even though he knows that a \u05de\u05dc\u05d0\u05db\u05d4 \u05d3\u05d0\u05d5\u05e8\u05d9\u05d9\u05ea\u05d0 will inevitably occur.<a href=\"#25\"><sup>25<\/sup><\/a> For instance, one may ask an <em>Aino Yehudi<\/em> to open a refrigerator door even though he knows the lightbulb will turn on automatically.<a href=\"#26\"><sup>26<\/sup><\/a> Similarly, one may ask an <em>Aino Yehudi<\/em> to take out ice from the icemaker, even though it will automatically turn on the icemaker to produce more ice. The rationale in both cases is that the Jew asked the <em>Aino Yehudi<\/em> to perform a permitted activity and the subsequent <em>melachah<\/em>, which is not an inherent part of the request, is not included within the prohibition of \u05d0\u05de\u05d9\u05e8\u05d4 \u05dc\u05e2\u05db\u05d5&#8221;\u05dd<a href=\"#27\"><sup>27<\/sup><\/a>.<\/li>\n<\/ol>\n<p>The laws of \u05dd\u05d5\u05db\u05e2\u05dc \u05d4\u05e8\u05d9\u05de\u05d0 are intricate, and small details can affect the <em>halachic<\/em> outcome. It is always recommended to consult a competent rabbi for further guidance.<\/p>\n<hr \/>\n<ol>\n<li id=\"1\">\u00a0\u05d2\u05de\u2019 \u05e9\u05d1\u05ea \u05d3\u05e3 \u05e7\u05e0 \u05e2\u201d\u05d0 \u05d5\u05e9\u05d5\u201d\u05e2 \u05e1\u05d9\u2019 \u05e9\u201d\u05d6 \u05e1\u05e2\u05d9\u2019 \u05d1<\/li>\n<li id=\"2\">\u05e8\u05e9\u201d\u05d9 \u05d1\u201d\u05de \u05d3\u05e3 \u05e2\u05d0 \u05e2\u201d\u05d1 \u05d3\u201d\u05d4 \u05d0\u05d3\u05e2\u05ea\u05d0, \u05d5\u05db\u05df \u05d1\u05e8\u05e9\u201d\u05d9 \u05e9\u05d1\u05ea \u05d3\u05e3 \u05e7\u05e0\u05d2 \u05e2\u201d\u05d0 \u05d3\u201d\u05d4 \u05de\u05d0\u05d9 \u05d8\u05e2\u05de\u05d0<\/li>\n<li id=\"3\">\u05e2\u05d9\u2019 \u05e9\u05d5\u201d\u05ea \u05d0\u05d1\u05e0\u05d9 \u05e0\u05d6\u05e8 \u05d0\u05d5\u201d\u05d7 \u05e1\u05d9\u2019 \u05de\u201d\u05d2 \u05d0\u05d5\u05ea \u05d5\u2019<\/li>\n<li id=\"4\">\u05d9\u05e9\u05e2\u05d9\u05d4 \u05e0\u05d7,\u05d9\u05d2<\/li>\n<li id=\"5\">\u05e8\u05e9\u201d\u05d9
