Q:<\/strong> Under which circumstances is a person obligated to erect a fence around the roof of his house?<\/p>\n\n\n\n

A:<\/strong> The Torah<\/em> in parshas Ki-Setze<\/em> states, \u201cWhen you build a new house make a railing for your roof, and you shall not bring blood on your house if someone falls from there\u201d.1<\/sup><\/a> The Torah<\/em> requires one to build a maakeh<\/em> \u2013 a fence \u2013 around a flat roof that people walk on, so as to protect them from falling. The mitzvah<\/em> applies not only to someone who builds a house but also to someone who buys, inherits or is gifted a house.2<\/sup><\/a> A person who rents a house is also required to build a maakeh<\/em> if the owner has not already done so.3<\/sup><\/a><\/p>\n\n\n\n

A maakeh<\/em> has to be strong enough that a person could lean against it without falling, and it has to be ten tefachim<\/em> high.4<\/sup><\/a> This measurement is 40 inches according to the Chazon Ish<\/em>.5<\/sup><\/a> The maakeh<\/em> must be constructed such that it does not have gaps through which a child could fall.6<\/sup><\/a> When a person builds a maakeh<\/em>, he recites a brocha<\/em>.7<\/sup><\/a> If he is building the maakeh<\/em> on his own property, the text of the brocha<\/em> is \u05d1\u05e8\u05d5\u05da \u05d0\u05ea\u05d4 \u05d4’ \u05d0\u05dc\u05d5\u05e7\u05d9\u05e0\u05d5 \u05de\u05dc\u05da \u05d4\u05e2\u05d5\u05dc\u05dd \u05d0\u05e9\u05e8 \u05e7\u05d3\u05e9\u05e0\u05d5 \u05d1\u05de\u05e6\u05d5\u05ea\u05d9\u05d5 \u05d5\u05e6\u05d5\u05e0\u05d5 \u05dc\u05e2\u05e9\u05d5\u05ea \u05de\u05e2\u05e7\u05d4. If he is building it on someone else\u2019s property, the text of the brocha<\/em> is \u05d1\u05e8\u05d5\u05da \u05d0\u05ea\u05d4 \u05d4’ \u05d0\u05dc\u05d5\u05e7\u05d9\u05e0\u05d5 \u05de\u05dc\u05da \u05d4\u05e2\u05d5\u05dc\u05dd \u05d0\u05e9\u05e8 \u05e7\u05d3\u05e9\u05e0\u05d5 \u05d1\u05de\u05e6\u05d5\u05ea\u05d9\u05d5 \u05d5\u05e6\u05d5\u05e0\u05d5 \u05e2\u05dc \u05e2\u05e9\u05d9\u05d9\u05ea \u05de\u05e2\u05e7\u05d4. 8<\/sup><\/a>One does not recite a brocha<\/em> of Shehechiyonu<\/em> on the building of a maakeh<\/em>.9<\/sup><\/a> Some Poskim<\/em> suggest that when a person performs this mitzvah<\/em> for the first time in his life, he should recite the brocha<\/em> of Shehechiyonu<\/em> on a new fruit or new article of clothing and have intent that the brocha<\/em> should also include the building of the maakeh<\/em>.10<\/sup><\/a><\/p>\n\n\n\n

The Poskim<\/em> debate whether the brocha<\/em> is recited at the beginning or end of the building of the maakeh<\/em>.11<\/sup><\/a> Rabbi Heinemann, shlit\u201da<\/em>, paskens<\/em> that it is recited immediately prior to the end of construction.12<\/sup><\/a> If a Jewish person hires a non-Jew to build the maakeh<\/em>, the Jew should finish the construction and recite the brocha<\/em> at that time.13<\/sup><\/a><\/p>\n\n\n\n

A person may build a maakeh<\/em> and recite the brocha<\/em> after purchasing a house before moving in.14<\/sup><\/a> Under those circumstances, he should demonstrate that he is residing in the house by eating a meal there at the time that he builds the maakeh<\/em>.15<\/sup><\/a><\/p>\n\n\n\n

One is required to build a maakeh<\/em> only on a roof which people use and upon which they walk.16<\/sup><\/a> A roof which is rarely accessed does not require a maakeh<\/em>. For this reason, sloped roofs generally do not require a maakeh<\/em>.17<\/sup><\/a> If a person has a flat roof and has not built a maakeh<\/em>, he should lock the entranceway to the roof so that people cannot access it.18<\/sup><\/a><\/p>\n\n\n\n

The mitzvah<\/em> of building a maakeh<\/em> applies to buildings owned by an individual but not to public buildings, such as a shul<\/em> or beis hamedrash<\/em>.19<\/sup><\/a> However, if the roof of those buildings are accessed by the public then a fence should be built due to safety concerns, as the Torah obligates us to ensure that the welfare of others is not put at risk.20<\/sup><\/a> In that case, no brocha<\/em> is recited.21<\/sup><\/a><\/p>\n\n\n\n

The Chazon Ish<\/em> states that a maakeh<\/em> is required only on the roof of a room or building in which people live. Therefore, a deck or porch would not require a maakeh<\/em>. However, due to safety concerns, a deck which is raised ten tefachim<\/em> above the ground should be fenced in.22<\/sup><\/a> If falling from the deck may potentially be dangerous, this barrier should be ten tefachim<\/em> high;23<\/sup><\/a> no brocha<\/em> is recited over its construction.<\/p>\n\n\n\n

A:<\/strong> The Torah in parshas Ki-Setze states, \u201cWhen you build a new house make a railing for your roof, and you shall not bring blood on your house if someone falls from there\u201d.1<\/a> The Torah requires one to build a maakeh \u2013 a fence \u2013 around a flat roof that people walk on, so as to protect them from falling. The mitzvah applies not only to someone who builds a house but also to someone who buys, inherits or is gifted a house.2<\/a> A person who rents a house is also required to build a maakeh if the owner has not already done so.3<\/a><\/p>\n
