{"id":2111,"date":"2015-07-06T17:05:48","date_gmt":"2015-07-06T17:05:48","guid":{"rendered":"https:\/\/www.star-k.org\/articles\/?p=2111"},"modified":"2016-05-11T16:32:55","modified_gmt":"2016-05-11T16:32:55","slug":"surprise-du-jour","status":"publish","type":"post","link":"https:\/\/www.star-k.org\/articles\/kashrus-kurrents\/2111\/surprise-du-jour\/","title":{"rendered":"Surprise Du Jour"},"content":{"rendered":"<p><em>Published Summer 2015<\/em><\/p>\n<div align=\"left\">\n<p><strong><span style=\"text-decoration: underline;\">TYPICAL RESTAURANT SCENE #1<\/span><\/strong><strong>:<i>\u00a0\u201cMa, I\u2019m going to grab something to eat before supper.\u201d\u00a0\u00a0\u201cFine, but don\u2019t make yourself\u00a0fleishig.\u00a0\u00a0We\u2019re having\u00a0milchigs\u00a0tonight.\u201d\u00a0\u00a0\u201cNo problem.\u00a0\u00a0I\u2019ll just get an order of fries from Kosher Burger!\u201d<\/i><\/strong><br \/>\nWas that a fatal supper flaw or not?\u00a0\u00a0Possibly, but it is not uncommon for a<em>fleishig<\/em>\u00a0restaurant to cook their\u00a0french\u00a0fries or onion rings in the same fryer that is used for chicken.\u00a0\u00a0If that is the case, the fries are 100%\u00a0<em>fleishig<\/em>\u00a0and the little boy is cooked!\u00a0\u00a0One would have to wait the required amount of time before eating a dairy meal.<a title=\"\" href=\"#_ftn1\" name=\"_ftnref1\"><sup>[1]<\/sup><\/a><\/p>\n<p>This is not the only\u00a0<i>pareve<\/i>\u00a0pitfall for an unassuming kosher consumer.\u00a0There are many other factors to be aware of when dining at a\u00a0<i>fleishig\u00a0<\/i>restaurant.\u00a0\u00a0Just as a fryer can be used for both meat and\u00a0<i>pareve<\/i>\u00a0products, so can the knives that are used to cut salad vegetables.\u00a0\u00a0Also, frying pans used between cutlets and vegetables, or ovens that cook any number of meat and\u00a0<em>pareve<\/em>\u00a0food items interchangeably, would cause the items served to be considered\u00a0<em>fleishig<\/em><em>.<\/em><a title=\"\" href=\"#_ftn2\" name=\"_ftnref2\"><sup>[2]<\/sup><\/a><\/p>\n<p><em>Halacha<\/em>\u00a0does make certain allowances for\u00a0<em>pareve<\/em>\u00a0dishes prepared in meat or dairy utensils.\u00a0\u00a0Those items would be considered in modern\u00a0<em>kashrus<\/em>terms ME or DE; that is, a\u00a0<i>pareve<\/i>\u00a0item cooked using clean Meat Equipment or Dairy Equipment.\u00a0\u00a0The status of these items is\u00a0<i>halachically<\/i>\u00a0different than a strictly\u00a0<i>pareve<\/i>\u00a0item cooking in a\u00a0<i>pareve<\/i>\u00a0vessel, or a\u00a0<i>pareve<\/i>\u00a0item cooked in a vessel containing meat or milk.\u00a0\u00a0True, you wouldn\u2019t have to wait six hours for\u00a0french\u00a0fries from a clean\u00a0<em>fleishig<\/em>\u00a0fryer free of any\u00a0<i>fleishig<\/i>\u00a0residue, but you would not be able to eat those fries with dairy items, such as pizza.<a title=\"\" href=\"#_ftn3\" name=\"_ftnref3\"><sup>[3]<\/sup><\/a>\u00a0Similarly, it is not permitted to eat\u00a0french\u00a0fries from a dairy fryer with a meat hamburger or hot dog.<a title=\"\" href=\"#_ftn4\" name=\"_ftnref4\"><sup>[4]<\/sup><\/a><\/p>\n<p>As kosher restaurants do not routinely maintain segregated fryers, due to the constant preparation of assorted meat and<em>\u00a0pareve<\/em>\u00a0items, keeping a \u201c<em>pareve<\/em>\u201d fryer is nearly impossible.\u00a0\u00a0Accidental splattering or interchanging of compatible equipment or cooking oil would make it very difficult to consider those fries\u00a0<em>pareve<\/em><em>,<\/em>\u00a0even if there is a separate fryer.\u00a0\u00a0Similarly, most fried Chinese noodles that are served as an appetizer in a kosher Chinese restaurant are cooked in the meat fryers and should be considered 100%\u00a0<em>fleishig<\/em>.<a title=\"\" href=\"#_ftn5\" name=\"_ftnref5\"><sup>[5]<\/sup><\/a><\/p>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"text-decoration: underline;\">TYPICAL RESTAURANT SCENE #2<\/span><\/strong><strong>:<i>\u00a0\u201cWhat do you want to order?\u201d \u201cI don\u2019t know, but I am not in the mood for meat.\u201d\u00a0\u00a0\u201cWhy don\u2019t you try some grilled\u00a0fish.\u00a0\u00a0It\u2019s delicious!\u201d<\/i><\/strong><\/p>\n<p>Ordering fish in a meat restaurant is a popular alternative to meat or chicken, and can create other<em>\u00a0halachic<\/em>\u00a0pitfalls to the unaware kosher consumer.\u00a0\u00a0It is common to offer fish entr\u00e9es on a meat restaurant menu.\u00a0Sushi bars have become very common in many\u00a0<em>fleishig<\/em>\u00a0establishments, as well.\u00a0\u00a0One of the\u00a0well known\u00a0<i>halachos<\/i>\u00a0regarding Jewish health concerns,<em>sakana,\u00a0<\/em>stipulates that one is forbidden to eat fish and meat together.<a title=\"\" name=\"_ftnref6 href=\"><\/a><sup>[6]<\/sup>\u00a0Therefore, fish items in reliably kosher certified\u00a0<i>fleishig<\/i>\u00a0restaurants are cooked and prepared using separate utensils.\u00a0\u00a0Furthermore, it is customary to drink a beverage and eat something\u00a0<em>pareve<\/em>\u00a0after the fish, such as a cracker or piece of\u00a0<em>challah<\/em>, before eating any meat<a title=\"\" href=\"#_ftn7\" name=\"_ftnref7\"><sup>[7]<\/sup><\/a>\u00a0if the fish was served as an appetizer.<\/p>\n<p>When a popular entr\u00e9e such as blackened salmon is ordered, it is common to request a fried side dish, such as rice,\u00a0french\u00a0fries or steamed vegetables that\u00a0compliment\u00a0the main dish.\u00a0\u00a0Rice is typically cooked in<i>pareve<\/i>\u00a0rice\u00a0cookers.However, if these items are cooked in common\u00a0<i>keilim<\/i>, they are considered to be\u00a0<em>fleishig<\/em><em>\u00a0and<\/em>\u00a0the consumer may unwittingly be violating the law of\u00a0<em>sakana<\/em>, eating fish and \u201cmeat\u201d together.<a title=\"\" href=\"#_ftn8\" name=\"_ftnref8\"><sup>[8]<\/sup><\/a>\u00a0\u00a0It is the policy of STAR-K certified restaurants to note on the menu whether vegetables are\u00a0<i>pareve<\/i>\u00a0or are to be considered\u00a0<i>fleishig<\/i>.<br \/>\n<b><i><br \/>\n<\/i><em><span style=\"text-decoration: underline;\">TYPICAL RESTAURANT SCENE #3<\/span><\/em><em>:<\/em><em>\u00a0\u201cWaiter, I am\u00a0Sefardi. I am\u00a0makpid(Beit\u00a0Yosef) on Bishul Yisroel.\u201d\u00a0\u00a0\u201cNo problem.\u00a0\u00a0We have a full-time mashgiach on the premises.\u201d<\/em><\/b><\/p>\n<p>Many of the items served in kosher restaurants or fast\u00a0food\u00a0eateries are<em>oleh<\/em><em>\u00a0al\u00a0shulchan\u00a0melachim,<\/em>\u00a0i.e., fit to be served at a banquet or state dinner, and are subject to the rules of\u00a0<em>Bishul Akum<\/em>.\u00a0\u00a0As such, food items that are 100% kosher yet cooked by an\u00a0<em>aino<\/em><em>\u00a0Yehudi<\/em>\u00a0are forbidden for consumption.<a title=\"\" href=\"#_ftn9\" name=\"_ftnref9\"><sup>[9]<\/sup><\/a>\u00a0\u00a0Often, restaurants employ cooks who are\u00a0<em>aino<\/em><em>\u00a0Yehudim.<\/em>\u00a0\u00a0\u00a0The\u00a0<i>Shulchan Aruch<\/i>\u00a0suggests different methods for avoiding\u00a0<i>Bishul Akum<\/i>.\u00a0\u00a0According to the<em>\u00a0Rema<\/em><em>,<\/em><a title=\"\" href=\"#_ftn10\" name=\"_ftnref10\"><sup>[10]<\/sup><\/a>\u00a0the\u00a0<em>mashgiac<\/em>h should make sure that he\/she turns on all the fires of any cooking appliance.\u00a0\u00a0This includes the stove, burners, steamers and rice cookers ensuring that all\u00a0<i>ole al\u00a0shulchan melachim<\/i>\u00a0items on the menu are\u00a0<em>Bishul Yisroel.\u00a0\u00a0<\/em><em>However, the\u00a0<\/em><em>Rema<\/em><em>\u2019s\u00a0<\/em><em>solution\u00a0for\u00a0\u00a0the\u00a0fulfillment of\u00a0<\/em><em>Bishul Yisroel<\/em><em>\u00a0will not satisfy\u00a0<\/em><em>Bishul YisroelSafardi<\/em><em>.\u00a0\u00a0<\/em>According to the\u00a0<i>mechaber<\/i><i>\u00a0Maron<\/i>\u00a0<em>Bais\u00a0Yosef,<\/em>\u00a0in order to satisfy<em>Bishul Yisroel<\/em>\u00a0the\u00a0<em>mashgiach\u00a0<\/em>would actually have to place the food in the lit oven or on the lit burner,<a title=\"\" href=\"#_ftn11\" name=\"_ftnref11\"><sup>[11]<\/sup><\/a>\u00a0light the fire when the food is on the burner, or put the actual food into a hot oven.\u00a0Therefore, while a restaurant might be in 100%\u00a0<i>halachic<\/i>\u00a0compliance and correctly advertises\u00a0<i>Bishul Yisroel<\/i>, the food being served may not be permitted to a\u00a0Sefardic\u00a0consumer if the food was prepared according to\u00a0<i>Bishul Yisroel Ashkenazi<\/i>.<\/p>\n<p>Some kosher doughnut shops offer more than kosher doughnuts and coffee.\u00a0They also serve muffins and croissants, eggs on a muffin, a popular breakfast menu item.\u00a0\u00a0The\u00a0<em>halacha<\/em>\u00a0states that eggs are\u00a0<em>oleh<\/em><em>\u00a0al\u00a0shulchan melachim<\/em>\u00a0and are subject to the laws of<em>\u00a0Bishul Akum<\/em>.<a title=\"\" href=\"#_ftn12\" name=\"_ftnref12\"><sup>[12]<\/sup><\/a>\u00a0\u00a0It goes without saying that even kosher certified doughnut shops do not have the luxury of<i>hashgacha<\/i><i>\u00a0temidis.\u00a0\u00a0<\/i>In order to avoid the prohibition of\u00a0<i>B<em>ishul Akum<\/em><\/i><em>, eggs are microwaved instead of conventional cooking.\u00a0\u00a0Microwaving is not subject to the laws of\u00a0<\/em><em>Bishul Akum<\/em><em>.<\/em><a title=\"\" href=\"#_ftn13\" name=\"_ftnref13\"><sup>[13]<\/sup><\/a>\u00a0However, if the doughnut shop prepares the omelets on the grill, the laws of<em>\u00a0Bishul Akum<\/em>\u00a0would certainly apply.\u00a0\u00a0If certification applies only to the doughnuts and coffee and does not cover the breakfast menu, an uninformed kosher consumer could inadvertently consume non-kosher eggs.<a title=\"\" href=\"#_ftn14\" name=\"_ftnref14\"><sup>[14]<\/sup><\/a><br \/>\n<b><i><br \/>\n<\/i><em><span style=\"text-decoration: underline;\">TYPICAL RESTAURANT SCENE #4<\/span><\/em><em>:<\/em><em>\u00a0\u201cIt is so nice to have the cousins together for this special evening.\u201d \u201cYes.\u00a0\u00a0It\u2019s great to have an elegant kosher restaurant in town.\u201d\u00a0\u00a0\u201cDo they serve wine?\u201d\u00a0\u00a0\u201cThey have a great selection!\u201d<\/em><\/b><\/p>\n<p>Many restaurants have different policies regarding\u00a0<i>mevushal<\/i>\u00a0wines.\u00a0\u00a0Some fine dining restaurants offer\u00a0<em>mevushal<\/em>\u00a0and non-<em>mevushal<\/em><em>\u00a0<\/em>wines, with a\u00a0<em>frum<\/em>\u00a0waiter to pour them.\u00a0\u00a0Other\u00a0<i>kashrus<\/i>\u00a0organizations permit only\u00a0<i>mevushal<\/i>\u00a0wines to be served.<a title=\"\" href=\"#_ftn15\" name=\"_ftnref15\"><sup>[15]<\/sup><\/a>\u00a0\u00a0Some customers will order a whole bottle of non-<i>mevushal<\/i>\u00a0wine for their party.\u00a0\u00a0If some of the guests are\u00a0<em>aino\u00a0<\/em><em>Yehudim<\/em>\u00a0and pour their own wine, the wine becomes\u00a0<em>stam<\/em><em>\u00a0yayin<\/em>\u00a0and cannot be used since the wine was not\u00a0<i>mevushal<\/i>.<a title=\"\" href=\"#_ftn16\" name=\"_ftnref16\"><sup>[16]<\/sup><\/a><\/p>\n<p><b><span style=\"text-decoration: underline;\">AND FOR THE FINAL SURPRISE \u2026<\/span><\/b><\/p>\n<p><strong><br \/>\nDo you think that kosher pizza shops or\u00a0<i>milchig<\/i>\u00a0restaurants don\u2019t have surprises?<\/strong>\u00a0\u00a0Have you ever topped your pizza, lasagna or baked ziti with parmesan toppings?\u00a0\u00a0Are you aware that the parmesan cheese topping is real grated hard cheese?\u00a0\u00a0Since the cheese is aged over six months and can only be cut by grating, one has to wait six hours before eating anything\u00a0<em>fleishig<\/em><em>.<\/em>\u00a0\u00a0Six hours\u00a0<em>milchig<\/em>\u2026 you\u2019ve got to be kidding!<a title=\"\" href=\"#_ftn17\" name=\"_ftnref17\"><sup>[17]<\/sup><\/a><\/p>\n<p>&nbsp;<\/p>\n<\/div>\n<div>\n<p>&nbsp;<\/p>\n<hr align=\"left\" size=\"1\" width=\"33%\" \/>\n<div align=\"left\">\n<div>\n<p><a title=\"\" href=\"#_ftnref1\" name=\"_ftn1\">[1]<\/a>\u00a0Either six\u00a0hours, three hours or one hour \u2013 depending upon laws of\u00a0<i>Bishul Akum<\/i>.<\/p>\n<\/div>\n<div>\n<p><a title=\"\" href=\"#_ftnref14\" name=\"_ftn14\">[14]<\/a>\u00a0Another common problem could arise from serving sandwiches.\u00a0\u00a0If tuna fish is one of the items available, who is watching the tuna fish preparation?\u00a0\u00a0Fish is an item requiring two\u00a0<i>simanim<\/i>, distinct identifications.\u00a0\u00a0Without proper\u00a0<i>hashgacha<\/i>, tuna sandwiches would be prohibited;\u00a0<i>Y.D.<\/i>\u00a083:3 &amp; 4.<\/p>\n<\/div>\n<div>\n<p><a title=\"\" href=\"#_ftnref15\"
