It is possible that there the food was made from a previous year\u2019s wheat crop and is <em>yoshon<\/em>. It is also possible that this year\u2019s crop took root before 16 Nissan and is <em>yoshon<\/em>. As there are two areas of doubt \u2013 a <em>sfek sfeika<\/em> \u2013 one can be lenient.<a href=\"#_ftn2\" id=\"_ftnref2\">[2]<\/a> Others disagree and maintain that there is only one uncertainty here, whether the grain is <em>chodosh<\/em> or <em>yoshon<\/em>, and one should be stringent.<a href=\"#_ftn3\" id=\"_ftnref3\">[3]<\/a><\/p>\n\n\n\n<p>\u25ba The <em>Bach<\/em> says that the prohibition does not apply to grain produced in a field owned by an <em>aino Yehudi<\/em>. Since most fields outside Eretz Yisroel are owned by <em>aino Yehudim<\/em>, one can be lenient.<a href=\"#_ftn4\" id=\"_ftnref4\">[4]<\/a> Others disagree, as prominent Rishonim clearly state that the prohibition applies equally to grain grown by <em>aino Yehudim<\/em>.<a href=\"#_ftn5\" id=\"_ftnref5\">[5]<\/a><\/p>\n\n\n\n<p>\u25ba The <em>Magen Avrohom<\/em> suggests that custom is to rely on the opinion of the Rishonim that the prohibition of <em>chodosh<\/em> is limited to Eretz Yisroel.<a href=\"#_ftn6\" id=\"_ftnref6\">[6]<\/a> Others disagree, as the majority of Rishonim <em>pasken<\/em> that the prohibition applies equally in <em>chutz la\u2019aretz<\/em>.<a href=\"#_ftn7\" id=\"_ftnref7\">[7]<\/a><\/p>\n\n\n\n<p>The <em>Mishna Berura<\/em> briefly mentions these three approaches. He then states that although one cannot protest if a person follows these leniencies, a <em>baal nefesh<\/em> (a pious person) should not rely on them and opt to be stringent.<a href=\"#_ftn8\" id=\"_ftnref8\">[8]<\/a><\/p>\n\n\n\n<p>It should be added that a number of the <em>Acharonim<\/em> who are lenient explicitly state that this is due to the dire need for food that they experienced in their time.<a href=\"#_ftn9\" id=\"_ftnref9\">[9]<\/a> It is quite possible that they would not have taken the same position in the time and countries that we live in now, when food is readily available.
