{"id":13108,"date":"2023-09-13T16:21:51","date_gmt":"2023-09-13T16:21:51","guid":{"rendered":"https:\/\/www.star-k.org\/articles\/?p=13108"},"modified":"2023-09-14T18:12:20","modified_gmt":"2023-09-14T18:12:20","slug":"shemita-after-shemita-its-not-over-yet","status":"publish","type":"post","link":"https:\/\/www.star-k.org\/articles\/kashrus-kurrents\/13108\/shemita-after-shemita-its-not-over-yet\/","title":{"rendered":"Shemita After Shemita: It\u2019s Not Over Yet!"},"content":{"rendered":"\n<p>Fall 2023<\/p>\n\n\n\n<p>There are those who think that whatever comes from Israel is kosher and who are not aware of the many issues associated with goods that are produced in Israel, be they concerns of <em>orla, terumos, maasros<\/em> \u2013 or <em>Shemita<\/em>. And they believe that once the <em>Shemita<\/em> year ends, <em>Shemita<\/em> issues are a thing of the past.<\/p>\n\n\n\n<p>The <em>Shemita<\/em> year ended more than a year ago. To many of us, it already seems like a distant memory, a topic that we will next revisit in roughly five years, when we prepare for <em>Shemita<\/em> of 5789. But the truth is that <em>Shemita<\/em> of 5782 is still very relevant. It is important to remember this because our brethren in <em>Chutz La\u2019aretz<\/em> are less aware of <em>mitzvos hatluyos ba\u2019aretz<\/em>.<a href=\"#_ftn1\" id=\"_ftnref1\">[1]<\/a> Since produce in the Diaspora are not subject to these laws, there is less awareness of <em>Shemita<\/em> repercussions.<\/p>\n\n\n\n<p>We are currently in a period which I would term, \u201c<em>Shemita after<\/em> <em>Shemita.<\/em>\u201d As you will see, there are several market sectors that are still very much affected by <em>kedushas shevi\u2019is<\/em>, long after the conclusion of <em>Shemita<\/em>. Let us explore the ramifications of this post-<em>Shemita<\/em> year period on produce, alcoholic beverages and raw materials, as well as on the \u201cguardians of <em>Shemita<\/em>\u201d who have made the ultimate sacrifice to keep this precious mitzvah.<\/p>\n\n\n\n<p><strong>Fruit<\/strong><\/p>\n\n\n\n<p>As was indicated in a previous <em>Kashrus Kurrents<\/em> article, the Halacha regarding fruits is that their <em>Shemita<\/em> status is determined by <em>chanata<\/em> (when they blossom), and not <em>lekita<\/em> (when they are picked). Fruits that blossomed during <em>Shemita<\/em> will not reach the market until the <em>following<\/em> year. Thus, many fruits circulating in the market currently may have blossomed during <em>Shemita<\/em> and are seventh-year fruits.<\/p>\n\n\n\n<p><strong>Vegetables<\/strong><\/p>\n\n\n\n<p>The <em>Shemita<\/em> period for <em>fresh<\/em> vegetables has ended, but that may not be the case for <em>canned<\/em> vegetables exported abroad \u2013 such as hummus, tomatoes, corn and pickles. These may well be from the <em>shevi\u2019is<\/em> crop.<\/p>\n\n\n\n<p><strong>Alcoholic Beverages<\/strong><\/p>\n\n\n\n<p>The Israeli wine industry has become a formidable player and export powerhouse. With the growing popularity of marketing Israeli wines abroad, so too is the challenge. It is worth noting that all the wine that is currently marketed in Eretz Yisrael is from the <em>shevi\u2019is<\/em> crop, and is thus vested with <em>kedushas shevi\u2019is<\/em>. The eighth year vintage began in the month of Av 5783.<\/p>\n\n\n\n<p>Exported <em>Shemita<\/em> wines are highly problematic. For one thing, many consumers are unaware that wines which bear a label stating &#8220;2022 vintage&#8221; were produced in the <em>Shemita<\/em> year. Additionally, there is a prohibition both to remove wine<a id=\"_ftnref2\" href=\"#_ftn2\">[2]<\/a> with <em>kedushas shevi\u2019is<\/em> from the Land of Israel and to engage in conventional commerce with it.<\/p>\n\n\n\n<p>Liquors have similar <em>Shemita<\/em> challenges. Gin, for example, is a thriving export industry in Israel that is heavily dependent on citrus products in its production \u2013 citrus peels, oranges and lemons. If the raw materials have <em>kedushas shevi\u2019is<\/em>, then the gin will, too.<\/p>\n\n\n\n<p><strong>Raw Materials<\/strong><\/p>\n\n\n\n<p>Speaking of raw materials, unbeknownst to most consumers, these can also have <em>Shemita<\/em> concerns. Raw material exports include food coloring from dried tomatoes, dietary fiber from vegetables, or flavors from <em>Shemita<\/em> oranges and lemons. Some of these products can have a shelf life of two to three years, in which case <em>Shemita<\/em> issues can still be relevant in the eighth year and beyond. Aromatic oils and essential oils, which are used in many food applications, can also have <em>Shemita<\/em> issues. Israel is a major exporter of citrus oil and extracts.<\/p>\n\n\n\n<p><strong>STAR-K\u2019s <em>Shemita<\/em> Policy: Complete Adherence to Halacha<\/strong><\/p>\n\n\n\n<p>At STAR-K Israel, we don&#8217;t rely on <em>Shemita<\/em> leniencies; we simply bow out of the game entirely. Following the <em>psak<\/em> of STAR-K Rabbinic Administrator Harav Moshe Heineman <em>shlit\u201da<\/em>, we will not rely on a <em>heter mechira<\/em> (the sale of land) nor on the <em>Otzar Beis Din<\/em><a href=\"#_ftn3\" id=\"_ftnref3\">[3]<\/a> to engage in normative commercial activity. &nbsp;<\/p>\n\n\n\n<p>&nbsp;Our Israeli wineries, such as Elul Winery and Katalev Winery, deal with wine from the sixth crop; during <em>Shemita<\/em>, their grapes lay fallow and their fields are not harvested \u2013 they leave the market for an entire year. These <em>tzaddikim<\/em> meticulously follow the Torah commandment to provide the land with a true Sabbatical rest: <em>v\u2019shavsa ha\u2019aretez Shabbos l\u2019Hashem<\/em>. &nbsp;<\/p>\n\n\n\n<p><strong>Lessons on Emunah from a Guardian of Shemita: Absolute Reliance on G-d\u2019s Promise<\/strong><\/p>\n\n\n\n<p><em>Emunah peshuta<\/em>: the simpler it is, the more admirable. What is the experience of a winery owner who sets aside his source of livelihood for an entire year and puts all his trust in G\u2011d?<\/p>\n\n\n\n<p>For Yossi Itach, owner of the Katalev Winery, there seems to be no question.<\/p>\n\n\n\n<p>\u201c<em>Shemita<\/em> for me is like Shabbat,\u201d he says simply, \u201cI don&#8217;t find a difference between what the Torah says about Shabbat and what is written about the <em>Shemita<\/em>. I also tell people who ask me to lecture on observance of the <em>Shemita<\/em>, why don&#8217;t you lecture on Shabbat? It\u2019s the same. The moment they say that <em>Shemita<\/em> should be kept, it means that there is a possibility that it should not. In my view, there is no such possibility.\u201d<\/p>\n\n\n\n<p>Asked how he deals with the economic challenge of putting his business on hold for an entire year, which can be likened to a deep pothole in the middle of the road, he responds simply: \u201c<em>Baruch Hashem<\/em>, I&#8217;ve been privileged to keep <em>Shemita<\/em> since 2001. It&#8217;s been four <em>Shemitas<\/em> and I\u2019ve had no setbacks. I appreciate that only good will come of it. As for the \u201cpothole\u201d you mentioned, I think if you travel in a car with good springs, you will ride over the potholes. If you believe, you get it back. It\u2019s as simple as that.<\/p>\n\n\n\n<p>\u201cPeople ask, \u2018What are you living from?\u2019 I respond that this is the only time in life that a person can look up and say, \u2018This is His problem.\u2019 G-d promised. And blessing isn&#8217;t just about money, it\u2019s much more than that.<\/p>\n\n\n\n<p>\u201c<em>Baruch Hashem<\/em>, &nbsp;I&#8217;m fine, I didn&#8217;t see a shortage, and the business continued to exist. We\u2019ve had ups and downs, not necessarily because of <em>Shemita<\/em>, but I think <em>Shemita<\/em> has a providence in itself. You see lights on <em>Shemita<\/em>. You see things working out for you alone, you don\u2019t have to make an effort. You see that the wine is doing well.<\/p>\n\n\n\n<p>\u201cEveryone was afraid that the break of activity during <em>Shemita<\/em> would ruin the vineyards. &nbsp;But see the vineyards now, after <em>Shemita.<\/em> They are awakened, resurrected, the fruit comes out properly, and this is without touching them throughout the <em>Shemita<\/em> year. \u201cI&#8217;m glad I have had the privilege to be a guardian of <em>Shemita<\/em>.\u201d<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><a href=\"#_ftnref1\" id=\"_ftn1\">[1]<\/a> i.e., <em>termuos, maasros, orla<\/em> and <em>shevi\u2019is<\/em>.<\/p>\n\n\n\n<p><a href=\"#_ftnref2\" id=\"_ftn2\">[2]<\/a> Actually, this applies to all produce from Israel.<\/p>\n\n\n\n<p><a href=\"#_ftnref3\" id=\"_ftn3\">[3]<\/a> See \u201c<em>The Otzar Beis Din: Shemita\u2019s Treasure Trove,<\/em>\u201d <em>Kashrus Kurrents,<\/em> Summer 2022, for an in-depth discussion of the <em>Otzar Beis Din<\/em>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Fall 2023<\/p>\n<p>There are those who think that whatever comes from Israel is kosher and who are not aware of the many issues associated with goods that are produced in Israel, be they concerns of orla, terumos, maasros \u2013 or Shemita.
