Recent changes in Starbucks\u2019 company policy vis-\u00e0-vis kosher have further elevated the confusion for the kosher coffee connoisseur. Let\u2019s dive in to clear out some of the haze.<\/p>\n\n\n\n<p>Unflavored roasted coffee beans, whole and ground, are considered kosher without a <em>hechsher<\/em>. Bearing this in mind, buying a cup of unflavored regular or decaf coffee should not present any kashrus issues. Some coffee vendors, however, sell kosher and non-kosher items, like bacon and ham-filled sandwiches. The <em>keilim<\/em> used for coffee and the <em>treif<\/em> items are at times washed together, causing <em>blios<\/em> (absorbed tastes) from the <em>treif<\/em> utensil to enter the coffee equipment.<\/p>\n\n\n\n<p>For example, at Starbucks, it\u2019s been established that the brew basket that holds the coffee grounds while the coffee is being made is sometimes washed with <em>keilim<\/em> that may have come into contact with <em>treif<\/em>. If we have a \u201cperfect storm\u201d situation in which the wash water is <em>yad soledes<\/em>,<a href=\"#_ftn1\" id=\"_ftnref1\">[1]<\/a> and no soap is added before the <em>treif<\/em> equipment is placed in the water, then the brew basket is considered <em>treif<\/em> and the coffee made afterwards is likewise <em>treif<\/em>.<\/p>\n\n\n\n<p>We do not know the cleaning procedures used by all coffee vendors, but most of them sell <em>treif<\/em> items along with coffee, and the possibility exists that similar <em>keilim<\/em> issues may be present. Based on these facts and assumptions, the <em>psak<\/em> should be that one is permitted to buy hot coffee only from vendors who one knows do not sell <em>treif<\/em>, or whose cleaning procedures do not impact the kashrus of the coffee. This is, in fact, STAR-K\u2019s opinion on purchasing coffee from stores that sell <em>treif<\/em> items.<\/p>\n\n\n\n<p>There is a key exception: one who is traveling from home \u2013 whether by car, rail, plane, bus or stagecoach \u2013 may stop at any rest stop, gas station, Dunkin\u2019 or Starbucks, and purchase a hot cup of their favorite brew. The reasoning behind this exception is a bit complex, but here goes.<\/p>\n\n\n\n<p>Our concern centers on <em>blios<\/em> from <em>treif<\/em> in the <em>keilim<\/em> used to make the coffee and the drinkware used to serve it. The halacha is that tastes that are <em>pagum<\/em> (off-tasting) do not have an ability to impart a <em>treif<\/em> status to kosher foods or utensils.<a href=\"#_ftn2\" id=\"_ftnref2\">[2]<\/a> The halacha also states that tastes absorbed in a utensil that is not a <em>ben yomo<\/em> (i.e., has not been used within 24 hours) are considered <em>pagum<\/em>.<a href=\"#_ftn3\" id=\"_ftnref3\">[3]<\/a><\/p>\n\n\n\n<p>Furthermore, Shulchan Aruch <em>paskens<\/em> that if one is unsure whether the eating utensils or cooking equipment owned by non-Jews were used for non-kosher within the last 24 hours, one may assume that they were not.<a href=\"#_ftn4\" id=\"_ftnref4\">[4]<\/a> This concept is known as <em>stam keilim ainon bnei yoman<\/em> \u2013 or just <em>stam keilim<\/em> in halachic shorthand. With this in mind, the Mechaber <em>paskens<\/em> that if someone mistakenly used the pot of a non-Jew to heat up something, the food is permitted since it is assumed that the pot was not used within the past 24 hours. (This is a great <em>din<\/em> to keep handy when faced with a <em>bedi\u2019eved<\/em> situation,<a href=\"#_ftn5\" id=\"_ftnref5\">[5]<\/a> like the one in the Shulchan Aruch.<a href=\"#_ftn6\" id=\"_ftnref6\">[6]<\/a>)<\/p>\n\n\n\n<p>So the question is, does buying coffee in a non-kosher establishment <em>while traveling<\/em> have the status of a <em>bedi\u2019eved<\/em> situation? If yes, we could apply the principle of <em>stam keilim<\/em> to the coffeemaking equipment and enjoy a guilt-free cup of Starbucks coffee. STAR-K Rabbinic Administrator Rabbi Moshe Heinemann <em>shlit\u201da<\/em> answered this question by marshalling a <em>Yad Ephraim<\/em><a href=\"#_ftn7\" id=\"_ftnref7\">[7]<\/a> which references a Nodah b\u2019Yehudah that discusses the propriety of Jews drinking coffee in the gentile-owned coffeehouses of 18th-century Prague.<a href=\"#_ftn8\" id=\"_ftnref8\">[8]<\/a><\/p>\n\n\n\n<p>The Nodeh B\u2019Yehudah addresses the drinking of coffee from the coffeehouse\u2019s mugs. It was assumed that the mugs had had non-kosher milk in them when the gentile patrons drank their coffee. In those days, there was no <em>heter<\/em> to drink <em>non-cholov Yisroel<\/em> milk (or <em>cholov stam<\/em>) and it was considered not kosher. Since disposables had yet to be developed, the only way to drink the coffee was by using mugs that had absorbed the taste of non-kosher milk. The Jews who drank from the non-kosher mugs had two possible <em>halachos<\/em> on which to rely:<\/p>\n\n\n\n<ol class=\"wp-block-list\" type=\"1\">\n<li>The mug was a <em>kli sheni<\/em> and therefore not hot enough to cause a transfer of <em>treif<\/em> milk taste into the coffee.<a href=\"#_ftn9\" id=\"_ftnref9\">[9]<\/a><\/li>\n\n\n\n<li>The halacha of <em>stam keilim<\/em>, referenced above, made the assumption that the utensils were not used within 24 hours, and any <em>blios<\/em> were <em>pagum<\/em>.<\/li>\n<\/ol>\n\n\n\n<p>The Nodeh B\u2019Yehudah dismisses the <em>kli sheni<\/em> <em>heter<\/em> by referencing the Taz and Rashal, who <em>pasken<\/em> that this only helps in a <em>bedi\u2019eved<\/em> situation. The Shach writes that we need to be strict in applying the <em>heter<\/em> of <em>kli sheni<\/em>&nbsp; regarding earthenware utensils, such as the mugs that were used. The <em>heter<\/em> of <em>stam keilim<\/em> also doesn\u2019t work here since he says that these mugs were certainly used daily. Therefore, the Nodeh B\u2019Yehudah <em>paskens<\/em> that these mugs should not be used <em>l\u2019chatchila<\/em>, and that whoever has it within their power to protest the practice of Jews drinking in gentile coffeehouses should do so.<a href=\"#_ftn10\" id=\"_ftnref10\">[10]<\/a><\/p>\n\n\n\n<p>Let\u2019s return to the present. With the prevalence of disposable cups, we no longer have the issue of non-kosher mugs in gentile-owned coffeehouses. But our issue is not mugs \u2013 it\u2019s the washing procedures that may mix <em>treif<\/em> dishes with the coffeemaking equipment. And the <em>heter<\/em> of <em>stam keilim<\/em> applies to <em>bedi\u2019eved<\/em> situations only, as previously mentioned.<\/p>\n\n\n\n<p>Rabbi Heinemann has ridden to our rescue using ten words in the Nodeh B\u2019Yehudah which say, \u201cWhen someone is traveling and is in a place where no kosher utensils are available, he is considered to be in a <em>bedie\u2019ved<\/em> situation and he may use the gentile-owned mug.\u201d<a href=\"#_ftn11\" id=\"_ftnref11\">[11]<\/a> The Nodeh B\u2019Yehudah allows the use of the mugs based on the <em>heter<\/em> of <em>kli sheni<\/em>, because traveling is a <em>bedi\u2019eved<\/em> situation.<\/p>\n\n\n\n<p>Rabbi Heinemann applies the same thinking to our modern coffeehouse issue. He says when someone is on the road traveling, he is considered to be in a <em>bedi\u2019eved<\/em> situation. Based on STAR-K investigations, we also know that the <em>treif<\/em> dishes at Starbucks are not always washed with the coffee equipment.<a href=\"#_ftn12\" id=\"_ftnref12\">[12]<\/a> Therefore, we can use the <em>heter<\/em> of <em>stam keilim<\/em> since we are in a <em>bedi\u2019eved<\/em> situation.<\/p>\n\n\n\n<p>Just remember, that as soon as you get home, you are no longer considered to be in a <em>bedi\u2019eved<\/em> situation; you are back in \u201c<em>L\u2019chatchila<\/em><a href=\"#_ftn13\" id=\"_ftnref13\">[13]<\/a> Land,\u201d and non-kosher coffee places should be avoided unless you are <em>absolutely<\/em> certain that no <em>treif<\/em> utensils are washed with the coffee equipment.<\/p>\n\n\n\n<p>Bear in mind that <em>even while traveling<\/em>, you may only order regular or decaf coffee, or a latte made with <em>cholov stam<\/em> (if you don\u2019t keep <em>cholov Yisroel<\/em>). Frappuccinos and other flavored coffee creations contain additional ingredients which need to be reviewed before they can be recommended.<a href=\"#_ftn14\" id=\"_ftnref14\">[14]<\/a><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><a href=\"#_ftnref1\" id=\"_ftn1\">[1]<\/a> Literally, the temperature at which someone will quickly remove his hand to avoid being burned. The food must be at least this hot before its taste is considered to have been transferred into a utensil. Rabbi Moshe Heinemann holds <em>yad soledes<\/em> is 120\u00b0F.<\/p>\n\n\n\n<p><a href=\"#_ftnref2\" id=\"_ftn2\">[2]<\/a> <em>Shulchan Aruch<\/em> 103.<\/p>\n\n\n\n<p><a href=\"#_ftnref3\" id=\"_ftn3\">[3]<\/a> Ibid.<\/p>\n\n\n\n<p><a href=\"#_ftnref4\" id=\"_ftn4\">[4]<\/a> <em>Y.D.<\/em> 122:6.<\/p>\n\n\n\n<p><a href=\"#_ftnref5\" id=\"_ftn5\">[5]<\/a> A scenario in which the halacha allows a lenient approach to be applied.<\/p>\n\n\n\n<p><a href=\"#_ftnref6\" id=\"_ftn6\">[6]<\/a> \u05e1\u05ea\u05dd \u05db\u05dc\u05d9\u05dd \u05d0\u05d9\u05e0\u05df \u05d1\u05e0\u05d9 \u05d9\u05d5\u05de\u05df is based on \u05e1\u05e4\u05e7 \u05e1\u05e4\u05d9\u05e7\u05d4: maybe this pot was not used within 24 hours, rendering any absorbed taste <em>pagum<\/em> (off tasting). Even if it was used within 24 hours, maybe the absorbed non-kosher taste is <em>pagum<\/em> in this particular food that was cooked, \u05d4\u05d5\u05d1\u05d0 \u05d1\u05d8\u05d5\u05e8 \u05e1\u05d9\u2019 \u05e7\u05db\u201d\u05d1 \u05d1\u05e9\u05dd \u05d4\u05e8\u05d0\u201d\u05e9.<\/p>\n\n\n\n<p><a href=\"#_ftnref7\" id=\"_ftn7\">[7]<\/a> Rabbi Ephraim Zalman Margolis, see in <em>Y.D<\/em>. 122: 6.<\/p>\n\n\n\n<p><a href=\"#_ftnref8\" id=\"_ftn8\">[8]<\/a> \u05e0\u05d5\u05d3\u05e2 \u05d1\u05d9\u05d4\u05d5\u05d3\u05d4 \u05d9\u05d5\u201d\u05d3 \u05e9\u05d0\u05dc\u05d4 \u05dc\u201d\u05d5.<\/p>\n\n\n\n<p><a href=\"#_ftnref9\" id=\"_ftn9\">[9]<\/a> The mug or bowl into which food from a pot on a fire is poured is called a <em>kli sheni<\/em>, a second-level vessel. The walls of this vessel are considered to have sufficiently cooled the temperature of the food to such an extent that it is no longer hot enough to transfer its taste into the vessel\u2019s walls.<\/p>\n\n\n\n<p><a href=\"#_ftnref10\" id=\"_ftn10\">[10]<\/a> The words of the Nodeh B\u2019Yehudah are illustrative of how serious he felt this issue: \u05d5\u05de\u05d4 \u05e9\u05d4\u05e9\u05d9\u05d1 \u05dc\u05d5 \u05d4\u05de\u05e9\u05d9\u05d1 \u05e9\u05d1\u05e4\u05e8\u05d0\u05d2 \u05e9\u05d5\u05ea\u05d9\u05df \u05d1\u05e0\u05d9 \u05ea\u05d5\u05e8\u05d4 \u05d1\u05d1\u05ea\u05d9\u05dd \u05e9\u05dc \u05d0\u05d9\u05e0\u05d5 \u05d9\u05d4\u05d5\u05d3\u05d9, \u05d9\u05d3\u05e2 \u05e8\u05d5\u05dd \u05de\u05e2\u05dc\u05ea\u05d5, \u05d0\u05dd \u05d4\u05dd \u05d1\u05e0\u05d9 \u05ea\u05d5\u05e8\u05d4 \u05d0\u05d9\u05e0\u05dd \u05d1\u05e0\u05d9 \u05d9\u05e8\u05d0\u05d4 \u05d5\u05d4\u05de\u05d4 \u05e7\u05dc\u05d9 \u05d3\u05e2\u05ea\u2026<\/p>\n\n\n\n<p><a href=\"#_ftnref11\" id=\"_ftn11\">[11]<\/a> The ten critical words from the Nodeh B\u2019Yehudah are: \u05d5\u05dc\u05d4\u05dc\u05db\u05d4 \u05dc\u05de\u05e2\u05e9\u05d4 \u05d1\u05d3\u05e8\u05da \u05d1\u05d0\u05d5\u05e9\u05e4\u05d9\u05d6\u05d0 \u05e9\u05d0\u05d9\u05df \u05e9\u05dd \u05db\u05dc\u05d9\u05dd \u05d0\u05d7\u05e8\u05d9\u05dd \u05de\u05d9\u05d7\u05e9\u05d1 \u05d3\u05d9\u05e2\u05d1\u05d3 \u05d5\u05db\u05d5.<\/p>\n\n\n\n<p><a href=\"#_ftnref12\" id=\"_ftn12\">[12]<\/a> The fact that the <em>treif<\/em> dishes are not washed with the coffee equipment every day allows us to avoid the issue the Shach mentioned earlier, that the mugs could not be allowed based on <em>stam keilim<\/em>, when they were used daily with non-kosher milk.<\/p>\n\n\n\n<p><a href=\"#_ftnref13\" id=\"_ftn13\">[13]<\/a> A scenario in which the strict halacha must be applied.<\/p>\n\n\n\n<p><a href=\"#_ftnref14\" id=\"_ftn14\">[14]<\/a> Visit the Starbucks page at https:\/\/www.star-k.org\/articles\/kosher-lists\/1709\/starbucks\/ on the STAR-K website for up-to-date information about both hot and cold Starbucks beverages and which are approved for consumption, both <em>l\u2019hatchila<\/em> and <em>bedi\u2019eved<\/em> only while traveling.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Summer 2023<\/p>\n<p>The STAR-K Hotline receives no end of calls from coffee heads who dote on their daily cup of joe, whether from a local Starbucks or a Dunkin\u2019 on the road.
