After moving in one hopes it doesn\u2019t turn in to an American nightmare. So many things to take care of; so many things to consider. Utilities, the structure, the appliances \u2013 the list is seemingly endless. Dealing with normal home issues is hard enough, just think how many more issues have to be considered in a kosher compliant home. Kosher <i>mezuzas<\/i> on all entrances. Kosher appliances to make the kosher kitchen user friendly. No trees hanging over the backyard area where the <i>sukkah<\/i> is to be built. Moreover, does anyone realize that roofs, porches, balconies and landings have to be kosher as well? How do you make a porch kosher compliant? The answer \u2013 build a <i>ma\u2019akeh<\/i>.<\/span><\/p>\n<p><span style=\"font-family: Arial,Helvetica,Geneva,Swiss,SunSans-Regular; font-size: small;\">What is a <i>ma\u2019akeh<\/i>?<\/span><\/p>\n<p><span style=\"font-family: Arial,Helvetica,Geneva,Swiss,SunSans-Regular; font-size: small;\">The <i>Torah<\/i> states in <i>Parshas Ki-Setze<\/i>, \u201cWhen you build a new house, then make a fence for your roof\u2026\u201d<a title=\"\" href=\"#_ftn1\" name=\"_ftnref1\"><sup>1 <\/sup><\/a> The object of this positive <i>mitzvah<\/i> is to prevent a person from accidentally falling, as the <i>posuk<\/i> continues, \u201c\u2026And you shall not put blood in your house, lest someone fall from there.\u201d<\/span><\/p>\n<p><span style=\"font-family: Arial,Helvetica,Geneva,Swiss,SunSans-Regular; font-size: small;\">A <i>ma&#8217;akeh<\/i> is required at the edge of any floor that people walk on, if the floor is more than ten <i>t&#8217;fachim<\/i> (40 inches)<a title=\"\" href=\"#_ftn2\" name=\"_ftnref2\"><sup>2<\/sup><\/a> above the ground or above the next floor. The fence itself must be at least ten <i>t&#8217;fachim<\/i> (40 inches) tall. Typical situations requiring a fence include:<br \/>\n<\/span><\/p>\n<ul>\n<li><span style=\"font-family: Arial,Helvetica,Geneva,Swiss,SunSans-Regular; font-size: small;\"><span style=\"font-family: Arial,Helvetica,Geneva,Swiss,SunSans-Regular; font-size: small;\">Balconies and many sun decks.<\/span><\/span>&nbsp;<\/li>\n<li><span style=\"font-family: Arial,Helvetica,Geneva,Swiss,SunSans-Regular; font-size: small;\">Many front and back porches, whose floors are more than 40 inches from the ground. It has come to our attention that the porches on many homes in the <i>Torah<\/i> community are more than 40 inches from the ground, but the porch rails are almost never the required 40 inch height of a kosher <i>ma&#8217;akeh<\/i>.<br \/>\n<\/span><\/li>\n<\/ul>\n<p><span style=\"font-family: Arial,Helvetica,Geneva,Swiss,SunSans-Regular; font-size: small;\">Here are some pointers to observe this <i>mitzvah d&#8217;oraysa<\/i> (<i>Torah<\/i> law) properly:<br \/>\n<\/span><\/p>\n<blockquote><p><span style=\"font-family: Arial,Helvetica,Geneva,Swiss,SunSans-Regular; font-size: small;\">1. You should erect any required <i>ma&#8217;akeh<\/i> as soon as one puts up a <i>mezuzah<\/i> after occupying premises. Certainly you should not wait more than 30 days.<br \/>\n<\/span><\/p>\n<p><span style=\"font-family: Arial,Helvetica,Geneva,Swiss,SunSans-Regular; font-size: small;\">2. The <i>ma&#8217;akeh<\/i> does not have to be a solid wall, but any spaces should be sufficiently narrow that a child cannot fall through. The <i>ma&#8217;akeh<\/i> should be sufficiently sturdy that it will hold back a person who falls against it.<br \/>\n<\/span><\/p>\n<p><span style=\"font-family: Arial,Helvetica,Geneva,Swiss,SunSans-Regular; font-size: small;\">3. For rented premises, it is the responsibility of the tenant, not the owner, to erect a kosher <i>ma&#8217;akeh<\/i> in all areas where one is required.<br \/>\n<\/span><\/p>\n<p><span style=\"font-family: Arial,Helvetica,Geneva,Swiss,SunSans-Regular; font-size: small;\">4. Just before securing the last piece to complete a <i>ma&#8217;akeh<\/i>, make the <i>bracha<\/i>: \u201c<i>Baruch\u2026asher kidshanu b\u2019mitzvosav v\u2019tzivanu la\u2019asos ma\u2019akeh<\/i>.\u201d However, no <i>bracha<\/i> is made if the space underneath the floor you are putting the <i>ma&#8217;akeh<\/i> around was not intended for living purposes (e.g., a front porch that just has a crawl space under it).<br \/>\n<\/span><\/p>\n<p><span style=\"font-family: Arial,Helvetica,Geneva,Swiss,SunSans-Regular; font-size: small;\">5. A <i>ma&#8217;akeh<\/i> is not required around a floor that is never used (for example, a back porch area that no one ever goes on).<br \/>\n<\/span><\/p>\n<p><span style=\"font-family: Arial,Helvetica,Geneva,Swiss,SunSans-Regular; font-size: small;\">6. A <i>ma&#8217;akeh<\/i> is not required if there are bushes or other objects below the edge of the floor that will prevent a person from falling more than ten <i>t&#8217;fachim<\/i>. Hence, if you have a sturdy hedge around your porch, a <i>ma&#8217;akeh<\/i> is not required along those sections where the porch floor is less than 40 inches above the hedge.<br \/>\n<\/span><\/p>\n<p><span style=\"font-family: Arial,Helvetica,Geneva,Swiss,SunSans-Regular; font-size: small;\">7. A <i>ma&#8217;akeh<\/i> of 40 inches is not required for stairs, even for those steps more than 40 inches above the ground. (And if you have a stair rail, the conventional height of 30 inches is fine.)<\/span><\/p>\n<p>&nbsp;<\/p><\/blockquote>\n<div align=\"left\"><span style=\"font-family: Arial,Helvetica,Geneva,Swiss,SunSans-Regular; font-size: small;\"><span style=\"font-family: Arial,Helvetica,Geneva,Swiss,SunSans-Regular; font-size: small;\">The <i>Medrash Rabba<\/i> comments on the <i>posuk<\/i> in <i>Mishlei<\/i> \u201cIt is a gracious accompaniment to your head\u2026\u201d that the <i>mitzvos<\/i> that one performs throughout his lifetime will accompany and surround him on his life journey. Which <i>mitzvah<\/i> heads the list? The <i>ma\u2019akeh<\/i>, the fence that one made on his roof.
