{"id":1151,"date":"2013-08-20T17:41:09","date_gmt":"2013-08-20T17:41:09","guid":{"rendered":"https:\/\/www.star-k.org\/articles\/?p=1151"},"modified":"2018-09-04T16:07:58","modified_gmt":"2018-09-04T16:07:58","slug":"otzer-bais-din-proper-distribution-of-shmitta-produce","status":"publish","type":"post","link":"https:\/\/www.star-k.org\/articles\/articles\/1151\/otzer-bais-din-proper-distribution-of-shmitta-produce\/","title":{"rendered":"OTZER BAIS DIN: Proper Distribution of Shmitta Produce"},"content":{"rendered":"<p><span style=\"font-family: Arial,Helvetica,Geneva,Swiss,SunSans-Regular; font-size: small;\"><b><i>Rav Aharon Tendler, Ner Israel Mechina High School<br \/>\n<\/i><\/b><br \/>\nOur rabbis have taught that if the Jewish nation would observe two <em>Shabbosos<\/em>, they would be immediately redeemed<a href=\"#Anchor-Endnotes-1\"><sup>1<\/sup><\/a>. \u00a0Generally, this is understood to mean that the redemption will come if we observe two consecutive <em>Shabbosos<\/em>. The question arises as to the significance of two <em>Shabbosos<\/em>, and many responses have been provided. \u00a0There is a beautiful answer offered by the former Chief Rabbi of Moscow, Rabbi Fishman, in his introduction to a commentary on the <em>Yerushalmi Mesechta<\/em> <em>Shevi&#8217;is<\/em>. \u00a0Rabbi Fishman maintains that the two <em>Shabbosos<\/em> actually refer to the seventh day of the week when we refrain from all <em>melacha<\/em>, constructive work, and the seventh year of <em>shmitta<\/em>, when we withdraw our ownership from \u00a0the land of Israel and declare all produce ownerless and available for all to take.<br \/>\n<!--more--><br \/>\nThose of us who live outside of Eretz Yisroel \u00a0do not have the opportunity to\u00a0observe the year of <em>Sabbatical<\/em> rest in the manner of those who live in the land of Israel.\u00a0 However, we are all concerned about the financial security of our brethren and wonder what we can do to help our fellow Jews. \u00a0The only guarantee we have is to follow what the <em>Torah<\/em> teaches us. \u00a0The<em> Torah<\/em><a href=\"#Anchor-Endnotes-1\"><sup>2<\/sup><\/a> clearly links the improper keeping of <em>shmitta<\/em> with the <em>golus<\/em>, our Diaspora experience. It is therefore appropriate that, especially during this <em>shmitta<\/em> year, when we are all filled with concern for the situation in Israel, we offer to support those who properly fulfill the laws of <em>shmitta<\/em>. \u00a0We should express our gratitude to them for doing their best to fulfill this important <em>mitzvah<\/em>. .<\/p>\n<p>This article will discuss the &#8220;kosher&#8221; method of distributing fruit to consumers during the <em>shmittah<\/em> year:<\/p>\n<p><strong>The Dilemma<br \/>\n<\/strong>In earlier generations, when Israel\u2019s economy was basically agrarian, the distribution and consumption of <em>shmitta<\/em> produce was relatively easy. \u00a0Although produce may not be picked for sale and must be made <em>hefker<\/em>, ownerless and available for all, a farmer was permitted to pick his own fruit for personal consumption, even that which had grown during the <em>shmitta<\/em> year. \u00a0As long as he did not sell the fruit to others or store it in his home past the proscribed time limits, and treated the fruit with the proper sanctity, it was perfectly permissible to consume personal produce grown during <em>shmitta<\/em>!<\/p>\n<p>Note: \u00a0The one exception to this is the prohibition of <em>s\u2019fichin<\/em>, vegetables that grow by themselves during the <em>shmitta<\/em> year which may not be consumed; and must be uprooted when they are noticed. \u00a0This is a rabbinic prohibition to deter untrustworthy people from planting vegetables and then claiming that their growth was unintentional &#8211; either from seeds that were left over from the previous year or \u00a0blown onto their field by the wind.<\/p>\n<p>Today, when Israel\u2019s economy is far more industrial and far less agrarian, accessing produce during <em>shmitta<\/em> is much more problematic.\u00a0 Most people do not have a variety of trees in their own backyard. \u00a0Since <em>shmitta<\/em> fruit may not be marketed, and a country needs to be fed, how can the local grocer or supermarket provide their customers with domestic produce during the <em>shmitta<\/em> year?<\/p>\n<p><strong>The Solution<br \/>\n<\/strong>There are two primary options available.<br \/>\n<strong><br \/>\nOne solution<\/strong> is a bit controversial and problematic. \u00a0There is a disagreement among the <em>poskim<\/em> whether fruit grown in Israel on land owned by non-Jews have the holiness of <em>shmitta<\/em>. Furthermore, is it halachically proper to sell Jewish-owned land to non-Jews? \u00a0The <em>Bais Yose<\/em>f rules that land may be sold to non-Jews and the fruit grown in the fields are divested of sanctity. \u00a0The <em>Mabi&#8221;t<\/em> rules that since the fruit grows in <em>Eretz Yisroel<\/em>, although the land may legally be owned by a non-Jew, produce is still holy. \u00a0The custom in <em>Yerushalayim<\/em> is to rely on the opinion of the <em>Bais Yosef<\/em>. We therefore find many supermarkets and fruit stands selling a variety of produce in <em>Yerushalayim<\/em> that was grown by Arabs. \u00a0However, the C<em>hazon Ish<\/em> is of the opinion that one must follow the opinion of the<em> Mabi&#8221;t<\/em>. \u00a0Since <em>Bnei Brak<\/em> follows the opinion of the <em>Chazon Ish<\/em>, they do not have this option available to them. \u00a0Stores in <em>Bnei Brak<\/em> do not market fruit grown on lands of Arab ownership within the borders of <em>Eretz Yisroe<\/em>l, the land of Israel.<\/p>\n<p>Additionally, a problem that arises with any arrangement to sell produce grown on Arab owned lands is the honesty and trustworthiness of the growers. \u00a0<em>Kashrus<\/em> agencies often have to match wits with Arab farmers and distributors who will purchase produce from Jewish farmers that do not observe <em>shmitta<\/em>, repackage fruit and sell the produce to the <em>kashrus<\/em> observing public as if they themselves had grown them! \u00a0Without this trust, it can be very burdensome and expensive to make sure that a <em>mashgiach<\/em> is present from the time of the harvest until it is delivered into the hands of trustworthy store keepers and who make sure that no switching will take place.<\/p>\n<p><strong>The preferred method<\/strong>, therefore, is that of the <em>Otzer Bais Din<\/em> &#8211; literally the &#8220;Storehouse of <em>Bais Din<\/em>&#8220;. \u00a0This concept works as follows: although the Torah forbids marketing the fruits of the Sabbatical year, <em>sheviis<\/em><a href=\"#Anchor-Endnotes-1\"><sup>3<\/sup><\/a>, it is clearly permitted to eat them. \u00a0Not only may the owner pick for his own needs, he may also pick fruit for a friend who needs, as long as he does not market the fruit as he normally does. Can I hire someone to go into my friend\u2019s field and pick fruit for me? \u00a0Certainly! \u00a0This doesn&#8217;t violate the laws of <em>shmitta<\/em> at all, <strong>since I&#8217;m not buying the fruit; rather I am paying someone for the labor on my behalf<\/strong>. \u00a0Taken one step further, I can even hire the farmer himself to harvest the fruits for me, and pay him a flat hourly fee for his labor, as long as it is clear that the money paid is for his labor on my behalf, and not a purchase of the fruits, which I am taking for free.<\/p>\n<p>Enter the<em> Otzer Bais Din<\/em>, as prescribed in a <em>Tosephta<a href=\"#Anchor-Endnotes-1\"><sup>4<\/sup><\/a><\/em>. \u00a0Based on the above principle, the <em>Bais Din<\/em> approaches a fruit growing farmer and hires him to harvest his own fruit for the public, in exchange for a flat wage. \u00a0This agreement stipulates that the farmer will transport the fruit to a storehouse rented by the <em>Bais Din<\/em>, who will distribute the fruit to the public. \u00a0The <em>Bais Din<\/em> is then permitted to pass on to the consumer the expense in making these fruits accessible to the publicConsequently, when the consumer picks up this fruit from a <em>Bais Din<\/em> distribution point, or from an authorized grocer , he isn&#8217;t paying for the fruit as a consumer; rather, he is simply reimbursing the <em>Bais Din<\/em> for making the ownerless fruits of <em>shmitta<\/em> accessible to him. Our farmer has thus been transformed with this arrangement from a purveyor of fruits, forbidden by the <em>Torah<\/em> during <em>shmitta<\/em>, to a common laborer earning a wage for his labor, which is permitted during <em>shmitta<\/em>.<\/p>\n<p>In contrast to fruit grown on land owned by non-Jews (according to the opinion of the <em>Bais Yosef<\/em>), fruit acquired through an <em>Otzer Bais Din<\/em> retains the holiness of <em>shmitta<\/em>, and must be handled with special care. \u00a0Scraps and peels may not be disposed of unless they have become fully rotten and may be eaten by those who observe <em>shmitta.<\/em>\u00a0 However, this may not be taken out of the <em>Torah<\/em> delineated boundaries of <em>Eretz Yisroel.<\/em><em><br \/>\n<\/em><br \/>\nMay a greater appreciation for the laws of <em>shmitta<\/em> and those that sacrifice to keep them hastily bring the complete <em>geulah<\/em>!<\/p>\n<p><\/span><span style=\"font-family: Arial,Helvetica,Geneva,Swiss,SunSans-Regular;\"><a name=\"#Anchor-Endnotes-1\"><\/a><b><span style=\"font-size: medium;\">Endnotes<\/span><\/b><span style=\"font-size: medium;\">:<\/span><br \/>\n<span style=\"font-size: small;\">1.
